So Much For The Constitution: FBI Needs No Warrant

How many dumbed down citizens does it take for a nation to submit to its own destruction?  Seems like we are quickly approaching that point.
The Obama administration is seeking to make it easier for the FBI to compel companies to turn over records of an individual's Internet activity without a court order if agents deem the information relevant to a terrorism or intelligence investigation. 
The administration wants to add just four words -- "electronic communication transactional records" -- to a list of items that the law says the FBI may demand without a judge's approval.  Government lawyers say this category of information includes the addresses to which an Internet user sends e-mail; the times and dates e-mail was sent and received; and possibly a user's browser history.  It does not include, the lawyers hasten to point out, the "content" of e-mail or other Internet communication. So the list of items the FBI can demand from you without a warrant "does not include the "content" of e-mail or other Internet communication."  "YET" I would add.  You do see what is going on here, right?

A United States Marine was taking some college courses between assignments.  He had completed 20 missions in Iraq  and Afghanistan.  One of the courses had a professor who was an avowed atheist, and a member of the ACLU.

One day the professor shocked the class when he came in.  He looked to the ceiling and flatly stated, "GOD, if you are real, then  I want you to knock me off this platform...  I'll give you exactly 15 min."   The lecture room fell silent.  You could hear a pin drop.  Ten minutes  went by and the professor proclaimed, "Here I am GOD, I'm still waiting."


It got down to the last couple of minutes when the Marine got out of his chair, went up to the professor, and cold-cocked him;  knocking him off the platform.   The professor was out cold.


The Marine went back to his seat and sat there, silently.  The other students were shocked and stunned, and sat there  looking on in silence.


The professor eventually came to,  noticeably shaken, looked at the Marine and asked,   "What in the world is the matter with you?  Why did you do that?"


The Marine calmly replied,  "GOD was too busy today protecting America 's  soldiers who are protecting your right to say stupid stuff and act like an idiot. 
So He sent me."


The classroom erupted in cheers!

PC§ 834b. INS Arrests

(a) Every law enforcement agency in California shall fully cooperate with the United States Immigration and Naturalization Service regarding any person who is arrested if he or she is suspected of being present in the United States in violation of federal immigration laws.
(b) With respect to any such person who is arrested, and suspected of being present in the United States in violation of federal immigration laws, every law enforcement agency shall do the following:
(1) Attempt to verify the legal status of such person as a citizen of the United States, an alien lawfully admitted as a permanent resident, an alien lawfully admitted for a temporary period of time or as an alien who is present in the United States in violation of immigration laws. The verification process may include, but shall not be limited to, questioning the person regarding his or her date and place of birth, and entry into the United States, and demanding documentation to indicate his or her legal status.
(2) Notify the person of his or her apparent status as an alien who is present in the United States in violation of federal immigration laws and inform him or her that, apart from any criminal justice proceedings, he or she must either obtain legal status or leave the United States.
(3) Notify the Attorney General of California and the United States Immigration and Naturalization Service of the apparent illegal status and provide any additional information that may be requested by any other public entity.
(c) Any legislative, administrative, or other action by a city, county, or other legally authorized local governmental entity with jurisdictional boundaries, or by a law enforcement agency, to prevent or limit the cooperation required by subdivision (a) is expressly prohibited. 
 
So, why is the Obama administration suing Arizona today when CA has tougher laws on illegal immigration? And CA takes it a step further by prohibiting sanctuary cities (like SF and LA) from interfering with the enforcement of immigration laws as well (3c). Is the Obama administration going to sue Calif, Rhode Island, Missouri and all the other states with existing laws or just the states that enforce
 them?

      With Congress gridlocked on an immigration bill, the Obama administration is considering using a back door to stop deporting many illegal immigrants - what a draft government memo said could be "a non-legislative version of amnesty."
      The memo, addressed to U.S. Citizenship and Immigration Services Director Alejandro Mayorkas and written by four agency staffers, lists tools it says the administration has to "reduce the threat of removal" for many illegal immigrants who have run afoul of immigration authorities.
      "In the absence of comprehensive immigration reform, USCIS can extend benefits and/or protections to many individuals and groups by issuing new guidance and regulations, exercising discretion with regard to parole-in-place, deferred action and the issuance of Notices to Appear," the staffers wrote in the memo, which was obtained by Sen. Charles E. Grassley, Iowa Republican.
      The memo suggests that in-depth discussions have occurred on how to keep many illegal immigrants in the country, which would be at least a temporary alternative to the proposals Democrats in Congress have made to legalize illegal immigrants.
      Chris Bentley, a USCIS spokesman, said drafting the memo doesn't mean the agency has embraced the policy and "nobody should mistake deliberation and exchange of ideas for final decisions."
      "As a matter of good government, U.S. Citizenship and Immigration Services will discuss just about every issue that comes within the purview of the immigration system," he said in an e-mail statement. "We continue to maintain that comprehensive bipartisan legislation, coupled with smart, effective enforcement, is the only solution to our nation's immigration challenges."
      He said the Homeland Security Department "will not grant deferred action or humanitarian parole to the nation's entire illegal immigrant population."
      The memo does talk about targeting specific groups of illegal immigrants.
      Mr. Grassley said it confirms his fears that the administration is trying an end-run around Congress.

      "This memo gives credence to our concerns that the administration will go to great lengths to circumvent Congress and unilaterally execute a backdoor amnesty plan," Mr. Grassley said.
The memo acknowledges some of the tools could be costly and might even require asking Congress for more money.
      At one point, the authors acknowledge that widespread use of "deferred action" - or using prosecutorial discretion not to deport someone - would be "a non-legislative version of 'amnesty.' "
      The authors noted several options for deferred action, including targeting it to students who would be covered by the DREAM Act, a bill that's been introduced in Congress.
      In testifying to the Senate Judiciary Committee on May 11, Mr. Mayorkas first said he was unaware of discussions to use these kinds of tools on a categorical basis, then later clarified that officials had talked about expanding the use of those powers.
      "I don't know of any plans. I think we have discussed, as we always do, the tools available to us and whether the deployment of any of those tools could achieve a more fair and efficient use or application of the immigration law," he said.
      He acknowledged, though, that he was not aware that those powers had ever been used before on a categorical basis.
      Sen. John Cornyn, the Texas Republican who queried Mr. Mayorkas on the subject, warned him against pursuing that strategy.
      "I think it would be a mistake for the administration to use administrative action, like deferred action on a categorical basis, to deal with a large number of people who are here without proper legal documents to regularize their status without Congress' participation. I will just say that to you for what it's worth," Mr. Cornyn, the ranking Republican on the Senate Judiciary immigration, border security and citizenship subcommittee, told Mr. Mayorkas.
      "The American public’s confidence in the federal government’s ability and commitment to enforce our immigration laws is at an all-time low," Mr. Cornyn said in a statement. "This apparent step to circumvent Congress – and avoid a transparent debate on how to fix our broken immigration system –  threatens to further erode public confidence in its government and makes it less likely we will ever reach consensus and pass credible border security and immigration reform.”

      After reports earlier this year that the agency was working on these sorts of plans, Senate Republicans, led by Mr. Grassley, have sent letters to President Obama and Homeland Security Secretary Janet Napolitano asking for details.
      In one letter, the senators warned the president against making an end-run around congressional authority to write immigration rules, and asked for Mr. Obama to promise that he would not use the rules to grant mass pardons.
      Rosemary Jenks, government relations manager for NumbersUSA, an organization that advocates for stricter immigration limits, said the memo is "an outrageous usurpation of congressional authority. It is unconstitutional, and a slap in the face to the American people."
      She said that the memo could explain why the push for an immigration bill has faltered in Congress.
      "This makes sense of the fact that [Senate Majority Leader Harry] Reid and [House Speaker Nancy] Pelosi and Obama are sitting back calmly content with not moving immigration reform this year - because they know Obama is trying to take care of it for them, without Democrats having to be tied down to a vote before the election," she said.
      On the other side of the political spectrum, immigrant rights groups have demanded that Mr. Obama halt deportations until he secures a broad legalization bill from Congress - legislation that supporters call "comprehensive immigration reform" because it would tackle enforcement, some aspects of legal immigration and the status of illegal immigrants at the same time.
      Two senators earlier this year wrote asking the administration to use its powers to stop deporting students who might be eligible for the DREAM Act, which would allow illegal immigrant college students brought to the U.S. at a young age to gain legal status. The legislation has not been passed by Congress.
      Mr. Obama has rejected halting deportations, but his administration has been more careful about whom it pursues.
      According to new figures from Immigration and Customs Enforcement, the administration has stepped up its efforts to deport illegal immigrants convicted of crimes, but removal of "non-criminal" illegal immigrants has slowed so far in fiscal 2010.

Arizonans will be grateful for some extra help from the National Guard, starting Sunday, in protecting the border and fighting drug violence -- especially now that a federal judge has blocked key parts of their recent illegal-immigration law.  But there's a more pressing border issue that goes beyond Arizona: the alliance between drug cartels and groups that aim to smuggle terrorists into our country through the Mexican border.


Last week's detonation along the Texas-Mexico border of an Improvised Explosive Device similar to those used in Iraq and Afghanistan strongly suggests that Hezbollah is working with the drug cartels -- and that America is unsafe.  Law-enforcement officials and intelligence analysts believe that terrorist groups like al Qaeda have been working with such gangs as the ruthless MS-13 to smuggle terrorists into America.

Intel briefings and other sources suggest that al Qaeda spends as much as $50,000 to smuggle in a single terrorist, while Hezbollah, funded by Iran, pays as much as $10,000.

Indeed, some analysts estimate that thousands of terrorists have already been smuggled into the United States through the Mexican border since 9/11.  Last year, a worker at the Mexican embassy in Beirut was caught selling visas to enter Mexico for $3,000 apiece.  Hezbollah terrorists know that once they get to Mexico they can make their way here through our southern border.

A congressional report on homeland security acknowledges this threat.  The report, "A Line in the Sand: Confronting the Threat at the Southwest Border," addresses the alarming rate at which the number of aliens referred to as "other than Mexican," or OTMs, are crossing the border.  Many OTMs are nationals and terrorists from countries such as Iran, Syria, Pakistan, Chechnya, Afghanistan and Iraq.

Our biggest threat is that a nuclear, dirty or biological bomb could be smuggled by OTMs into America soon.

Hezbollah, the most sophisticated terrorist organization today, trains al Qaeda members in centers in Lebanon's Bekaa Valley before they leave for terror destinations via Syria, my sources there report.  The organization manufactures IEDs in Lebanon and has perfected their use since the 1980s.

An alliance between the drug cartels and Hezbollah is a symbiotic, win-win situation for both parties.  Hezbollah can share its expertise in tunnel-engineering and bomb-making with the drug cartels.  The cartels can then smuggle dealers and drugs through these tunnels, several of which have been discovered in recent years, while Hezbollah smuggles terrorists and munitions to be used in terror missions in America.

Hezbollah is Iran's proxy army and is trained by the Iranian Revolutionary Guards.  As Iran and America head into a confrontation over Iran's nuclear program, Iran must ensure it has sufficient operatives in America to retaliate when the time comes, and this alliance provides the means to get them here.  That time is coming faster than we think.

Intelligence analysts think Hezbollah has at least 11 cells in America, including one in New York City.  If provoked, perhaps via an Israeli strike, it is likely Iran will retaliate not only against Israel but against its strongest ally.

Our border-security crisis extends beyond illegal workers and employers looking for cheap labor.  A suitcase bomb or biological bomb detonated in any major city in America would kill untold numbers of civilians and wreak havoc on our economy.  Health care, prison housing and other costs for illegal immigrants would ultimately pale in comparison to such devastation.

Terrorists now have operational centers all over South AmericaThey're learning Spanish and obtaining fake Spanish papers in case they're caught crossing over the Mexican border.  The Tri-Border region of Argentina, Brazil and Paraguay in South America has become a haven for international Islamic extremists.  A State Department report notes that Hezbollah and other terrorist groups were using bases in Latin America to "raise millions of dollars annually via criminal enterprises."

Americans must put politics aside and act now to secure the Mexican border.  Arizona families are in need of protection from the drug violence, but we must protect the millions of Americans living in major cities who are threatened by a suitcase bomb or the like smuggled through the Mexican border.

The time for bickering is over.

o'bamacide - Court OKs Fetus Wrongful Death Car Crash Suit (FindLaw.com)



In what looks to become a slippery slope, a Wisconsin 4th District Court of Appeals gave the green light for a man to sue his unborn child's mother's insurance company for wrongful death, after the woman's negligent driving played a part in a car accident. Following the accident, the mother gave birth to a stillborn fetus.

Shannon Tesar, the father of the fetus, is seeking damages from the mother's insurance company based on the death of his unborn child, reports the Associated Press. Tesar's case was originally denied when the lower court ruled that the mother did not owe a legal duty to the fetus. The reversal has brought up some real concerns that the court is opening the door to other types of suits against mothers for nearly any action that can harm unborn children, such as poor dietary habits.

To put it simply, Tesar could argue that the fetus was like a passenger in the car, and was killed as a result of the accident. This argument rests on the fact that the fetus was a stillborn at the hospital, and therefore at a developmental stage capable of living on its own. One of the threshold questions in this case may be whether the fetus was viable for purposes of affording the unborn child the status of a person in the eyes of the law. Whether or not the fetus is viable will serve to determine if the mother breached her legal duty to the fetus. Should viability not be an issue, this case would likely play out as if the unborn child had already been born at the time of the accident, essentially sitting shotgun when the accident occurred.

A stretch? Perhaps. But viability is not the only legal hurdle Tesar will have to jump. Another difficult question this case poses is whether Tesar will be able to calculate a reasonable determination of damages. Many states do not allow suits based on the wrongful death of a fetus for this very reason- damages are impossible to calculate to any degree of certainty. Courts often return a modest award for children and elderly, as it is much more difficult to quantify life at the beginning and ending states without becoming overly speculative in nature. A successful wrongful death action requires a showing of negligent or intentional conduct of another that brought about a death. In this case, Tesar needs to prove that negligent driving brought about the death of the fetus, and that he has suffered a financial loss.

What distinguishes this case from those involving fetal murder hinges on the nature of the activity that brought about the death. In this case, Tesar is not alleging that the mother intended to kill the fetus, but that her negligent actions played a role in the death and he deserves to be compensated for his loss.

Obama is downplaying the importance of the leak of thousands of classified documents. But he won?t be able to laugh off the latest allegations. We have now learned that with quick action he and his White House Staff may have been able to limit the damage, but they were too incompetent to act.

When asked by Judge Andrew Napolitano of Fox News why he should not be held responsible for potential deaths caused by the leak, Julian Assange, the founder of Wikileaks, answered that he contacted the White House about the leaks before they were released and asked them to review them. The White House?s response?

Nada.

They were too busy golfing, partying with Paul McCartney and spending the summer vacationing. In subsequent email conversations Assange?s people clarified that they sought this response through the New York Times.

COURT: STUDENT CAN BE EXPELLED FOR CHRISTIAN BELIEFS

A federal judge ruled in favor of a public university who removed a Christian student over her belief that homosexuality is morally wrong. The decision, according to Julea Ward?s attorneys, could result in Christian students across the country being expelled from public university for similar views.

?It?s a very dangerous precedent,? Jeremy Tedesco, legal counsel for the conservative Alliance Defense Fund told FOX News Radio. ?The ruling doesn?t say that explicitly, but that?s what is going to happen.?

U.S. District Judge George Caram Steeh dismissed Ward?s lawsuit against Eastern Michigan University. She was removed from the school?s counseling program because she refused to counsel homosexual clients.

The university contended she violated school policy and the American Counseling Association code of ethics.

?Christian students shouldn?t be expelled for holding to and abiding by their beliefs,? said ADF senior counsel David French. ?To reach its decision, the court had to do something that?s never been done in federal court: uphold an extremely broad and vague university speech code.?

OMB nominee got $900,000 after Citigroup bailout

President Obama's choice to be the government's chief budget officer received a bonus of more than $900,000 from Citigroup Inc. last year -- after the Wall Street firm for which he worked received a massive taxpayer bailout.

The money was paid to Jacob Lew in January 2009, about two weeks before he joined the State Department as deputy secretary of state, according to a newly filed ethics form. The payout came on top of the already hefty $1.1 million Citigroup compensation package for 2008 that he reported last year.

Administration officials and members of Congress last year expressed outrage that executives at other bailed-out firms, such as American International Group Inc., awarded bonuses to top executives. State Department officials at the time steadfastly refused to say if Mr. Lew received a post-bailout bonus from Citigroup in response to inquiries from The Washington Times.

But Mr. Lew's latest financial disclosure report, provided by the State Department on Wednesday, makes clear that he did receive a significant windfall.

The Journolist story demonstrates active, covert collaboration among leftists to plant political themes in the media. Long-time listeners of conservative talk radio are aware of audio montages where old-line media talking heads repeat verbatim a set of words that can't be anything other than shared talking points. A perfect example was the 2000-era Dick Cheney "gravitas" showcased by Rush Limbaugh.

It's one thing to ask how proper reporting of Obama might have changed the outcome of the election. I'll ask a bigger question: Did old-line media journalists share talking points to prop up the global warming issue?

In his August 2007 American Thinker article "Global Warming Propaganda Factory," Christopher Alleva described the coordinated efforts of the Society of Environmental Journalists:

(Apr11)   In 8 years, President Bush added $5 trillion to the national debt; President Obama, according to a revised Dec11 GAO report, added $4T+ to the U.S. deficit in 2011 alone!  The GAO estimates the deficit, including o'scamcare & mandates, may grow from $15T+ to over $26T+!  UPDATE: A little-noticed event occurred at approximately midnight on Monday, October 31, 2011.  The National Debt exceeded the GDP!  Imagine what these numbers are going to be now that Obama is reelected!
