     Google CEO, Eric Schmidt once said, "if you have something that you don't want anyone to know, maybe you shouldn't be doing it in the first place."
     Mark Zuckerberg, Facebook CEO, said, "The age of privacy is over."
     Scott McNealy, chief executive officer of Sun Microsystems said, "You have zero privacy anyway. Get over it."
     As evident from the quotes above, corporations use propaganda just as dangerously as governments do. These are misleading statements that crony capitalists and government bureaucrats believe is you should accept as truths. Not so.
     Your best defense is, as is so often the case, knowledge. Improve your awareness and share the enduring value of privacy with your loved ones, friends, and neighbors:
     "The right to be let alone - the most comprehensive of rights and the right most valued by civilized men." --  Supreme Court Justice Louis Brandeis, Olmstead v. U.S., 277 U.S. 438 (1928)
     TSA Makes Texans a "Deal They Can't Refuse"
     In recent days, the Texas House unanimously passed a bill (138-0) making it a criminal offense for a security agent, such as TSA agents, to perform any search that would be offensive to a reasonable person by inappropriately touching travelers on the anus, sexual organ, buttocks, or breasts.
     This is a popular bill, especially among those who've been on the receiving end of an invasive groping – just for going on vacation, visiting loved ones, or rushing on a business trip to make a living.
     Unfortunately, TSA and Department of Justice intimidators derailed it by threatening to shut down all Texas airports if the bill passed. In response, the Texas Senate took the "deal they couldn't refuse" and withdrew the bill without even bothering to vote on it. It's not as if their lives were threatened, yet they gave in to pressure and ignored the desires of their constituents.
     "The two enemies of the people are criminals and government, so let us tie the second down with the chains of the Constitution so the second will not become the legalized version of the first."  Many people attribute the above quote to Thomas Jefferson; however, Monticello historians haven't been able to find this direct quote in his works. The point is, it's up to you to protect your privacy and help your friends, neighbors, and loved ones gain the awareness of what privacy means and the value of safeguarding it. Corporations, the feds, and criminals are not going to do it for you.
     "People Change Their Behavior When Being Observed..."
     The headline above is an abridged explanation of the "Hawthorn Effect" in psychology. Typically, it has a beneficial effect in a business or industrial setting, because employees tend to do better work when they know they're being watched.
     The dark side is you (and almost everyone you know) will change your behavior because you are, or think you are, under surveillance. This is a dangerous practice for a free society. Looking back at history, we can see the oppressive outcome of societies under surveillance, where everything is recorded and kept on file.
The American Library Association (ALA) states its position on privacy well, "The right to privacy is the right to open inquiry without having the subject of one's interest examined or scrutinized by others.... Privacy is essential to the exercise of free speech, free thought, and free association....When users recognize or fear that their privacy or confidentiality is compromised, true freedom of inquiry no longer exists... best practice leaves the user in control of as many choices as possible. These include decisions about the selection of, access to, and use of information. Lack of privacy and confidentiality has a chilling effect on users' choices. All users have a right to be free from any unreasonable intrusion or surveillance..."
     Microsoft Now Owns Skype; New Privacy Threat?
     If you wanted your phone conversations "left alone" so you could freely express your thoughts and feelings, Skype has been a good tool to consider.
     Its P2P infrastructure and encryption protocols made it a strong choice to keep your personal communications private.
     Corporations and governments have banned employees from using it at work partly because they had a difficult time monitoring the communication. Also, since Skype was not a traditional phone carrier, it was able to avoid forced installation of "lawful" interception capability (automated wire tapping/eavesdropping equipment such as other landline and mobile carriers must operate).
     Now that Microsoft owns Skype, this may all change. Microsoft will likely integrate Skype within its products such as the Lync unified-communications platform, Outlook, Xbox Live, and its mobile-phone platform. This may eventually make it easier to monitor communications.
     Privacy is vital to the fabric of our society. "The right to be let alone" is not an old-fashioned idea, as many crony capitalists and legalized government goons want you to believe.

Take these executive orders, for instance:

•  Executive Order 10995: Seizure of all communications media - radio, television, newspapers, CB and Ham radio, telephones and the internet (in effect, suspension of the first amendment)
  
• Executive Order 10997: Seizure of all electrical power and fossil fuels
  
• Executive Order 10998: Seizure of all food sources, farms and farm equipment. Food will be rationed. Today some states have anti-hoarding laws on the books, stating that anything over a one week's supply of food is considered hoarding and against the law.
  
• Executive Order 10999: Seizure of all transportation and control of all highways, interstates and seaports. Any vehicle, public or private, can be taken.
  
• Executive Order 11000: Seizure of all civilians for work under Federal supervision.
  
• Executive Order 11003: Seizure of all airports and aircraft, public or private.
  
• Executive Order 11004: Housing and Finance given authority for population relocation.
  
• Executive Order 12919: Directs various Cabinet officials to be ready to take over virtually all aspects of the United States economy during a "state of national emergency" at the direction of the president.
  
• Executive Order 13010: Directs FEMA to take control over all government agencies in times of emergency. FEMA is under the direct control of the executive (presidential) branch of government.
  
• Executive Order 11490: Establishes presidential control over all United States citizens, businesses, and churches in times of "emergency"

     These are executive orders passed by presidents -- Republican and Democrat alike -- elected to preserve our freedoms and the Constitution. Their very duplicities show that they have no intention of honoring the ideals of the constitutional republic handed down to us, that they are the very men that the Founders warned us about.

In fact, our Founders understood that this constitutional model could be overturned and made ineffective should the restraining power of the people against the federal government be made moot through judicial or legislative process.

     Men like John Adams, James Madison, George Washington, Thomas Jefferson, and Alexander Hamilton all viewed the separation of powers to be indispensible to the continuation and preservation of liberty and the United States.

     So what does the passage of these Executive Orders tell us? It tells us this ...

     The dominoes are in place to subject the American people to a state of martial law nationwide.

     And the sad thing is, this isn't even a new occurrence. American presidents, governors, and mayors have flexed their martial-law-imposing muscles at various times throughout our history.

• In 1871, President Grant sent troops into South Carolina to confiscate all private guns.
  
• In 1914, President Wilson ordered the infantry into Colorado to disarm everyone involved in a labor union dispute, including members of law enforcement and the National Guard.
  
• In 1993, the U.S. Army provided advice, tactical support, and military equipment to the FBI and the BATF to raid the Branch Davidian compound in Waco, Texas, which resulted in the deaths of 74 men, women and children.
  
• Martial Law was declared by General Andrew Jackson during the War of 1812.
  
• President Lincoln declared it again during the War Between the States, arresting anyone who dissented from his war-time policies, including newspaper editors and legislators.
  
• In 1931, Texas Governor Ross used National Guard troops to enforce limits on the size of private property.
  
• Much of the Pacific Coast was under martial law after the attack on Pearl Harbor.
  
• And as recently as 2005, New Orleans was under orders of martial law after Hurricane Katrina, orders which stripped remaining law-abiding citizens of their ability to protect and defend themselves and their property.

     Not only do we have Executive Orders paving the way for martial law, we have precedence for it. All that's needed in order to put it into motion is a trigger point, whether real or imaginary.

 1. On September 11, 2001 thousands of people lost their lives in a brutal assault on the American people and the American form of government. We mourn the loss of these innocent lives and insist that those who perpetrated these acts be held accountable.

 9. We should applaud our political leaders in the days ahead who have the courage to say that our freedoms should not be limited.
10. We must have faith in our democratic system and our Constitution, and in our ability to protect at the same time both the freedom and the security of all Americans.

The Second Amendment for Troops?

     Tucked away in the fiscal 2012 defense authorization bill  that the House passed Thursday is a curious provision: an amendment that would ensure that troops deployed to Afghanistan or Iraq have the “right to bear arms.”

     You read that correctly. The House voted 260 to 160 to approve an amendment to the bill that would revise the military’s “rules of engagement” to ensure troops in conflict zones can defend themselves.
     Seem a bit redundant? Rep.  John Mica (R., Fla.), who introduced the amendment, insists that it is not.
     Rep. Mica said the proposed legislation – what he described as the “little amendment that could” – was a response to front-line troops in Afghanistan who told him they “felt constrained” by the current rules of engagement.
     March, Rep. Mica visited Afghanistan as part of a congressional delegation. “You meet with all the big cheeses and generals and everything,” he said. “But … the fascinating part was going to forward operating positions and meeting with some of the troops they brought in.”
     As Rep. Mica recalled, he asked troops, “Is there anything I could do to help you do your job better?”
     Their unanimous answer? “You’ve got to change the rules of engagement.”
     If the amendment becomes law, it would direct the secretary of defense to “ensure that the rules of engagement applicable to members of the armed forces assigned to duty in any hostile fire area … fully protect the members’ right to bear arms; and authorize the members to fully defend themselves from hostile actions.”
     The amendment, Rep. Mica said, was not an attempt to “micromanage” the war from Washington.
     Rules of engagement are an occasional subject of controversy. U.S. military doctrine emphasizes minimizing the use of force to win over the population from insurgents. But U.S. commanders in Afghanistan last year eased some rules restricting the use of force, in part over concern that some commanders had misinterpreted tactical guidance that discouraged the use of airstrikes or artillery.
     Those rules were a source of frustration for some troops. Nonetheless, military rules of engagement typically make it clear that troops always have the right to self defense.  As this 2005 “ROE card” from Iraq  puts it: “Nothing on this card prevents you from using deadly force to defend yourself.”
     A spokesman for U.S. Central Command, the military headquarters that oversees operations in Iraq and Afghanistan, said the amendment, as worded, would likely not change a thing. “Troops always have the right to protect themselves in combat,” the spokesman said.

Palin arrived with Willow on the front of the motorcycle she was driving and her husband, Todd, and oldest daughter, Bristol, on separate bikes.

Supreme Court Overrules Fourth Amendment!

Fox News' Judge Andrew Napolitano reports that Supreme Court has given police the right to invade your home on a whim - that whim could simply mean that they know that you own firearms!

 NAPOLITANO: "SAFETY WITHOUT LIBERTY IS TYRANNY."

     The Supreme Court's ruling in Kentucky v. King now gives law enforcement officials the authority to enter your home without obtaining a search warrant in "expanded" circumstances! 
      In no quarter does the Fourth Amendment apply with greater force than in our homes, our most private space which, for centuries, has been regarded as entitled to special protection.
     The purpose of the Fourth Amendment is to protect citizens' privacy and property rights; but the Supreme Court's decision now allows authorities to violate those rights, and to stage a search and seizure of property without obtaining a warrant from a judge. Just think about what this will do to your Second Amendment rights!
     The "government has denied property and privacy rights in deference to making the job of the police easier," Napolitano said on Fox News. "Why would we let our own government do to us, what we fought a revolution against 230 years ago?"
     The warrant requirement ranks among the fundamental distinctions between our form of government, where officers are under the law, and the police-state where they are the law.
   If the Supreme Court can do this to the Fourth Amendment, then it is just a matter of time before they rule against the First and Second Amendments!
   WE MUST POUND CONGRESS with emails!    This ruling annihilates the Fourth Amendment and gives police the authority to enter your home without obtaining a warrant from a judge.  This issue affects everyone! Also, your generous DONATION to CCRKBA is urgently needed to drive this issue on Capitol Hill so that we can push Congress to vote to protect Americans' Constitutional rights.
     The Fourth Amendment was written to protect us from police excess and police mistakes. In lieu of presenting their evidence to a neutral magistrate, police officers may now knock, listen, then break the door down, never mind that they had ample time to obtain a warrant.

NO CHECKS AND BALANCES! We are in the middle of a crisis, and our Constitution is at stake!

Law-abiding citizens will now have to live in fear of the government - with every single knock at the door!  What if you go for protection in your night stand, thinking there was an intruder. They break down the door, you react in a panic to protect  

your family, they shoot you and justify it with the New Police State Rules.  The new rules that steal your rights under our Constitution.

     "The Fourth Amendment of the Constitution guarantees the right to be left alone," Judge Napolitano added. "It requires that the government can only come on to private property without the consent of the occupant, if it has a search warrant. And search warrants may only be issued by judges, and judges may only issue search warrants after they have found probable cause of a crime on the property."
     But with the Supreme Court's ruling, the Fourth Amendment has been trampled on and everything has changed!  Police will no longer be required to obtain a search warrant from a judge before they can lawfully enter a residence.   Once they enter your home and discover that you own firearms, what will they do?    Tell Congress: "Pass a law that will supersede this Supreme Court's ruling!"

       If they can do this to the Fourth Amendment, then it is just a matter of time before they go after the Second Amendment!  By enabling police to circumvent the Fourth Amendment and a judge's authorization before searching a property, Americans are no longer protected against unwarranted search and seizure.   This is an annihilation of your Fourth Amendment rights!  No one is safe! This ruling is the IMMEDIATE REVOCATION of our private property rights.  Every American is adversely impacted by this inane Supreme Court ruling.  "Rather than placing more pressure on police to stay in line with the Constitution, the court places the weight of proving constitutional rights on citizens,"   The Seattle Times reports. "The ruling leaves the Constitution's protection against warrantless searches as a symbolic right, easily sidestepped in practice by police. This leaves the law too open to the interpretation of law-enforcement personnel." 

     The Fourth Amendment was established to protect citizens from government encroachment and to ensure that law enforcement protect the residents in their communities without violating citizens' privacy rights.

     There is a domino effect afoot - today they are dismantling the Fourth Amendment and tomorrow they'll be knocking on your door to remove the Second.

     How secure are you if a police officer can knock on your door and enter your homes without a warrant?  Their word against yours, and no way for you to protect yourself from this intrusion and all they have to do is say they "thought you were committing a crime."  How secure are you and your family?

     Consider what Indiana residents are going through after their state Supreme Court ruled that police can enter private property at any time --- without a warrant, without suspicion, without reason ... SEARCH AND SEIZURE.   Justice Steven David wrote that the Barnes v. State of Indiana decision ruled that "the common law right to resist a police officer illegally entering a home no longer exists."    "A boundary has been crossed, and we're not just going to tolerate it," Sean Shepard said to a reporter for the Northwest Indiana Times. "As citizens, it's our job to be ever-vigilant against our government."   This is not a Red state or Blue state issue.  The erosion of our Fourth Amendment affects every resident of every state who simply wants the government to respect their freedom and their rights.

Today it's the Fourth Amendment; Tomorrow it's the Second!
THE TIME TO ACT IS NOW

     WE MUST POUND CONGRESS WITH eMails, Faxes and phone calls!   If the Supreme Court can rule against the Fourth Amendment, then it is just a matter of time before they rule against the Second Amendment! WARNING re 2nd paragraph - 'Gun Ownership v Violent Crime' & 'FBI COINTEL?'

It is important that you remain vigilant.  The State is.

      Re the 2nd paragraph in the original email attached below my opine:

     "If I was still carrying a badge/gun/credentials, probably I'd do the same as the FBI; however, from a civilian viewpoint I am disconcerted, regardless of the intent, to hear that direct contacts by federal agents are being made seeking information (informants?) from Gun Clubs, stores, the 'shooting community', when at the same time, as reported by a local, that a Walmart employee said that all ammo sales were being reported to the FBI!

     Both sources know the difference between the FBI, ATF, DHS or local 'JTTF', so apparently federal agents are abnormally soliciting "domestic terrorist" intel on all civilians, without profiling a target, and definitely outside any statutory directives that I've ever heard of.  It's not only "terrorists" being monitored, it's you ...and it's happening not just in Connecticut & Utah, but right here in Southern California too!" -- rfh

     I wonder if the federal bureaucracy today keeps as good a set of records on you as the Gestapo did on its subjects? 

     If you read the example flyer, you will see that it describes the very items that the 'disarm Americans' zealots (SPLC, IANSA, liberal Democrats, 'do-gooders') want regulated out of civilian access, it describes, nearly verbatum/item-for-item from proposed ATF regulations.

   Some of the vague 'suspicious activity' described in the flyer, matches what several states & the DHS, a couple of years back, tried to keep hidden from public scrutiny, ... how to identify/classify someone as being a 'domestic terrorist.'  Note:  I'm not talking about mid-East ones nor their home-grown fellow travelers!

    It won't be long before every thing about you is known, maybe even more than you know about yourself, that'll be needed by a run-away bureacracy to authorize/sanction actions/or use against you as it sees deems necessary for 'the good of the State.'

    I say to the 'do-gooders' behind what o'who? calls his 'under the radar' strategy, ...be careful, be very careful what you wish for.  Once the powers you seek are implemented by enforcers, the 'unintended consequences' of the application of that power usually rides roughshod over everyone and liberals & the 'intelligencia' are usually the 1st to be rounded up.

Gun Ownership Skyrockets, While Violent Crime Drops -Again

     This week, the FBI estimated that the number of violent crimes decreased 5.5 percent from 2009 to 2010, including a 4.4 percent decrease in the number of murders.  Because the U.S. population increased during the period, the figures imply that the total violent crime per capita rate and the murder rate decreased more than six percent and five percent, respectively.  Based upon the preliminary data, it appears that violent crime fell to a 37-year low and murder fell to a 47-year low.  The FBI will report final figures for 2010 later this year.

     We're repeating ourselves, but, as has been the case for quite a while, the decrease in crime coincided with an increase in the number of privately owned guns - particularly handguns and detachable magazine semi-automatic rifles.  For example, Americans bought over 400,000 AR-15s in 2009, and trends in AR-15 sales over the last few years suggest a similar number for 2010.

     Those who have followed the gun control issue for a few years probably have noticed that with crime declining and gun numbers rising year after year, gun control groups have all but abandoned their previously perennial claims that more guns equal more crime. Even their friends in the news media don't believe it anymore.  The Violence Policy Center and, breaking with past habit, the Brady Campaign didn't even try to claim that the decrease in crime in 2010 was attributable to gun control. 

FBI OVERBOARD ON SUSPICIOUS CUSTOMER WARNING?: 

     Since the Bureau of Alcohol, Tobacco, Firearms and Explosives is responsible for enforcing federal gun laws, dealers and other federal firearm licensees typically contact that agency (or state or local police) when they encounter suspicious customers.  So, it raised eyebrows when the FBI began circulating flyers in gun shops and ranges, encouraging owners of those businesses to report suspicious customers to  "your local Joint Terrorism Task Force" instead.  

     The flyers ( << click to see an example) first appeared in Connecticut, with a revised version appearing more recently in Utah.
