Judging the Nanny State Policies
Judge Andrew Napolitano argues the government's use of the Commerce Clause is unconstitutional.
And, I'll bet my gardening & the 'food police' comment, "If they can't outlaw it, they'll regulate it.", fell on deaf ears:
OUTLAW Gardens? Maybe Not. REGULATE Gardens? Maybe. -- rfh
U.S. Senate bill seeks restriction of personal gardens-- http://ohiorepublic.blogspot.com/2010/11/us-senate-bill-seeks-restriction-of.html
Called the "food safety modernization act", S.510 would outlaw gardening and saving seeds, in the name of "safety." Obviously, it is an unconstitutional violation of intrastate commerce, if anyone other than a liberty activist still cares about the Constitution. It would also enable the Department of Homeland Security(!) to make Manna Storehouse an ordinary occurrence. [ police officers used SWAT-style tactics to burst into the (Stowers') home, hold family members, including children, at gunpoint and confiscate the family's personal food supply. ] The Senate voted for cloture yesterday, with a Yes vote from Ohio's Sherrod Brown. We must urge Sen. Voinovich and future Sen. Portman to vote against it; and let Sen. Brown that we are agin' him on this bill. The only good thing I can say about it is the (black) humor it has generated in Facebook: When gardening is outlawed, only outlaws will have gardens.
UPDATE: The lame duck Democrat Congress rushed through a new "School Lunch" program for the tune of around $4.5 Billion dollars claiming the childhood obesity is a "National Security" issue, best not left to parent's control ...rather to the will of the State! ~~ rfh
