Mocking a war combat veteran's wounds and thereby his defense of our Country is trash journalism at its worse.  I didn't think the "IV Press" would ever stoop this low with a yellow journalism left leaning agenda.  Publishing under the guise of "Another View ... 2nd Amendment - CCW "Let them eat cake!"

Once, entering the Capital Building in Washington, D.C., I encountered a group of outraged, livid, very angry and vocal security stationed at an entrance frequently used by Senators and Congressmen. The officers were venting steam after having just had an encounter with a Senator who had read the officers "the riot act" for not allowing the Senator's 'private bodyguard' into the building without first relieving himself of several weapons and going through the metal detector screening procedure, as even us armed federal agents would normally do. The Senator, recently departed, was a strident and ardent anti-gun legislator. His view of Rights, in practice, certainly weren't what he preached to the masses. He, like so many elected officials and legislators, saw himself as exalted ..above the restrictions levied upon 'commoners.'

And they would have us eat cake?

Warning: Like so much "do-gooder' law bending, the original "legislative intent" is deliberately ignored when convenient for those in power whenever they are pushing some agenda or another, usually resulting in a blow being struck against individual rights.  For example, see the Customs' regulation proposal below.   Notice how easily 'regulations' can be changed so you rarely notice.

Often, the trouble with laws often is in their interpretation and implementation.  Enforcement beyond the 'original intent.'  Until you personally are on the receiving end of "Big Brother" or are a victim of violent crime such concerns are probably meaningless.   However, you may encounter forces beyond your command and control.  Recall Waco, Ruby Ridge, every day crime news. 

When you vote, consider being a defenseless crime victim or alone against misguided forces of the State.   Vote to protect yourself from a future State run-amok and from evil-doers would who love nothing more than to find you defenseless and make you squeal like a pig.

P.S.  I believe the guy on the right in the Get Angry 'group mug-shot' above is someone who was rioting against our government and its policies while, in the opinion of many, disgracing himself and his uniform some years ago in Washington, D.C.  And, is the woman in the middle a closet CCW?  And is she, and the man on the left, are they both hyprocrital anti-gun zealots?  Do they secretly carry on with guns?  Are they among the priviliged elite consorting above the realm of us commoners?  The mainstream news media have been aware that several antigun proponents are carrying concealed firearms but have failed to expose this hypocrisy.

WARNING:  Once a law or regulation change 'cracks open a door' ever-so-slightly into the area of individual rights, it is inevitable that the door will some day be flung wide open and those 'representing the law' will trample over areas not considered when the bill was originally conceived. ...just as often happens with the 1st, 2nd, 4th, and 10th Amendments.  (Recall Miami & Elian Gonzalez.)

VERY IMPORTANT PENDING KNIFE REGULATION:   The US Customs Service is attempting to administratively change the definition of a switchblade knife, to include imported "assisted open" knives.  The language done to do so is so broad that it can be used to outlaw almost every one-hand opening lock blade knife in the U.S.  The public comment period has already expired, so the only way to fight this is to write your senator or congressman and raise a fuss.  Sample letter.   (An example of mis-guided albeit well intended.)

'Blood' gangs targeting homes that display flags on private residences.  I'm sharing this information because I thought it sure serve as a warning to my Law Enforcement brothers. The gang members who were recently arrested for home burglary said in their de-brief that they target homes displaying the American Flag.  It was their experience that most in Law Enforcement or prior Military Service personnel display flags.  And they have found that these homes typically have weapons in the home.  While its not science it sure made sense to me.

Health care legislation back behind closed doors

 WASHINGTON (AP) - Health care talks slip back behind closed doors Wednesday as Senate leaders start trying to merge two very different bills into a new version that can get the 60 votes needed to guarantee its passage.

All eyes are on Senate Majority Leader Harry Reid of Nevada, who has said he wants to complete the wedding quickly and get historic health care overhaul legislation onto the floor the week after next.
Both bills were written by Democrats, but that's not going to make it easier for Reid. They share a common goal, which is to provide all Americans with access to affordable health insurance, but they differ on how to accomplish it.

The Finance Committee bill that was approved Tuesday has no government-sponsored insurance plan and no requirement on employers that they must offer coverage. It relies instead on a requirement that all Americans obtain insurance.

Sen. Olympia Snowe, the only committee Republican who supported advancing the Finance panel bill, suggested Wednesday a scenario in which a government-run plan could eventually come into play.
Snowe told CBS's "The Early Show" that she believes a public option would give the government "a disproportionate advantage" over private insurers, and said she still opposes the concept.

But at the same time, Snowe said that she wants "to make sure the insurance industry performs." In a separate interview on ABC's "Good Morning America," she said that if the industry did not live up to congressional expectations for more widely affordable and accessible insurance, "you could have the public option kick in immediately."

The Senate Health, Education, Labor and Pensions Committee bill, passed earlier by a panel in which liberals predominate, calls for both a government plan to compete with private insurers and a mandate that employers help cover their workers. Those are only two of dozens of differences.

President Barack Obama acknowledges it's not going to be easy. Speaking Tuesday in the Rose Garden, Obama called the 14-9 Finance Committee vote "a critical milestone" toward getting a health care overhaul this year. The legislation won its first Republican support when Snowe broke ranks with her party, saying she was answering the call of history.

Obama wasn't ready to bask in the bipartisan glow.

"Now is not the time to pat ourselves on the back," he said. "Now is the time to dig in and work even harder."

There was no victory lap either for Finance Committee Chairman Max Baucus of Montana. "The bottom line here is we need a final bill, a merged bill, that gets 60 votes," he said. "Our goal is to pass health care reform, not just talk about it."

Aides say Reid has a keen sense of what the Senate will pass and he is focused on finding a solution that can get the 60 votes needed to overcome a Republican filibuster.

In general, bills moving toward floor votes in both houses would require most Americans to purchase insurance, provide federal subsidies to help those of lower incomes afford coverage and give small businesses help in defraying the cost of coverage for their workers.

The measures would bar insurance companies from denying coverage on the basis of pre-existing medical conditions and for the first time limit their ability to charge higher premiums on the basis of age or family size. Expanded coverage would be paid for by cutting hundreds of billions of dollars from future Medicare payments to health care providers. Each house also envisions higher taxes - an income tax surcharge on million-dollar wage-earners in the case of the House, and a new excise levy on insurance companies selling high-cost policies in the Senate Finance Committee bill.

Apart from Snowe, Finance Committee Republicans cited higher taxes, a greater federal role in the insurance industry and other concerns as they lined up to oppose the bill.

Sen. Charles Grassley, R-Iowa, said the legislation would place the nation on a "slippery slope to more and more government control of health care."

Snowe said there were problems with the bill but the risks of doing nothing were too great.
Across the Capitol, Speaker Nancy Pelosi and her lieutenants have been at work for weeks trying to blend legislation approved by three House committees. The eventual result is certain to include a government option, but the details of the plan have split the rank and file and leaders have spent days struggling with the issue.

This blog concentrates on my concerns as an attorney about the imminent and growing threats to our Constitution and our form of government.  We have reason to be very afraid of what is happening. THE TRUTH ABOUT THE HEALTH CARE BILL Well, I have done it!  I have read the entire text of proposed House Bill 3200: fhe Affordable Health Care Choices Act of  2009.  I studied it with particular emphasis from my area of expertise, constitutional law.  I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional.  What I found was far worse than what I had heard or expected. To begin with, much of what has been said about the bill and its implications is in fact true, despite what the Democrats and  the media are saying.  The bill does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession. The bill will also eventually force private insurance companies out of business and put everyone into a government-run system. All decisions about personal health care will ultimately be made  by federal bureaucrats, and most of them will not be health care  professionals.  Hospital admissions, payments to physicians, and  allocations of necessary medical devices will be strictly controlled. However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices.  Instead, it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated.  If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.  The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government.  The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own.  The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with.  I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care. The paragraph below is really frightening. This legislation also provides for access by the appointees of the Obama administration of all of your personal health care  information, your personal financial information, and the information of your employer, physician, and hospital.  All of this is a direct violation of the specific provisions of the 4th Amendment to the Constitution protecting against unreasonable searches and seizures.  You can also forget about the right to privacy.  That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide. If you decide not to have health care insurance or if you have private insurance that is not deemed "acceptable" to the "Health Choices Administrator" appointed by Obama, there will be a tax  imposed on you.  It is called a "tax" instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment.  However, that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without due process of law. So, there are three of those pesky amendments that the far left hate so much out the original ten in the Bill of Rights that are effectively nullified by this law.  It doesn't stop there, though.  The 9th Amendment provides, "The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people."  The 10th Amendment states,  "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people."  Under the provisions of this proposed bill, neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control. I could write many more pages about this legislation, but I think you get the idea.  This is not about health care; it is about seizing power and limiting rights.  Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation" to support the Constitution.  If I were a member of  Congress, I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation.  If I voted for it anyway, I would hope the American people would hold me accountable.
