censorship - YouTube Pulls Hitler 'Downfall' Parodies

Adolf Hitler isn't a funny subject. But for the past couple of years there's been a series of popular parodies on YouTube that use a grim scene from a German drama about Hitler's last days and turn it into caustic satire. The parodies have been incredibly popular, but then all of a sudden they started to disappear. Fans say they are a victim of a misguided copyright enforcement system on YouTube.

The popular parodies use a scene from an Academy Award-nominated film called Downfall,in which Hitler, played by Bruno Ganz, is told bad news about the German defenses. A tired, nervous-looking officer tells the Fuhrer the truth, and Hitler goes on an angry rant.  [see, "Der Untergang" at  http://www.youtube.com/watch?v=PxFPxvyu6qk]

If you don't understand the German -- and most Americans don't -- you read the subtitles. That's where the fun happens. People add their own subtitles. In one recent version Hitler gets told that the new iPad can't multitask.

Hitler rants about its lack of Flash, lousy AT&T service, the name that suggests a feminine hygiene product. Using this scene the subtitles have had Hitler ranting about everything from Kanye West's behavior on the MTV awards to Patti LuPone winning a Tony.

Parodies Disappear From YouTube

Millions of people have seen at least one version. Then a couple of days ago, the videos started to disappear.

Constantin Films, which owns the rights to Downfall, decided to use YouTube's content ID system. It works like a fingerprint system: A content owner puts its film or song into content ID, and YouTube can find every video that uses any part of, say, a film like Downfall.

YouTube's Aaron Zamost says it has more than 1,000 content owners using the system.

"We're scanning every user upload against a reference database of over 3 million files," he says.

The content ID system was a response by the Google-owned YouTube to complaints by big media companies that people were stealing their content when they put it up on YouTube. Zamost says the system also lets content owners keep up their clips and put ads next to them so they can make money.

"We tried to build a tool that allows rights holders to manage the use of their content by users but that also gives them, say, an option to make money from it," he says.

Would It Hold In Court?

That may be great for content owners, but it may not be in line with copyright law.

Corynne McSherry, an attorney with the Electronic Frontier Foundation, explains how fair use works: It lets people use a film clip or a paragraph from an article or a piece of music if they are creating commentary or satire.

McSherry has seen many of the Downfall parodies.

"All the ones that I've seen are very strong fair use cases and so they're not infringing, and they shouldn't be taken down. But via this filter system they are taken down virtually automatically," she says.

Hitler parodies are appearing on other sites, including one that makes fun of Constantin Films. YouTube's Zamost says that the people who put their parodies on YouTube can appeal and have them put back up.

Then, if Constantin Films wants to take them down it will have to sue. And if McSherry is right, the company is not likely to win in a U.S. court.

Old Butch

 

John was in the fertilized egg business.

 

He had several hundred young layers (hens), called 'pullets,' and ten roosters to fertilize the eggs.

 

He kept records, and any rooster not performing went into the soup pot and was replaced.

 

This took a lot of time, so he bought some tiny bells and attached them to his roosters.

 

Each bell had a different tone, so he could tell from a distance, which rooster was performing.

 

Now, he could sit on the porch and fill out an efficiency report by just listening to the bells.

 

John's favorite rooster, old Butch, was a very fine specimen, but this morning he noticed old Butch's bell hadn't rung at all!

 

When he went to investigate, he saw the other roosters were busy chasing pullets, bells-a-ringing, but the pullets,hearing the roosters coming, could run for cover.

 

To John's amazement, old Butch had his bell in his beak so it couldn't ring. He'd sneak up on a pullet, do his job and walk on to the next one.

 

John was so proud of old Butch, he entered him in the Renfrew County Fair and he became an overnight sensation among the judges.

 

The result was the judges not only awarded old Butch the No Bell Piece Prize but they also awarded him the Pulletsurprise as well.

 

Clearly old Butch was a politician in the making. Who else but a politician could figure out how to win two of the most highly coveted awards on our planet by being the best at sneaking up on the populace and screwing them when they weren't paying attention.

 

Vote carefully next time, the bells are not always audible.

Rise of the State: Police investigating "The Joker" satire posters

Is this selective enforcement? If the posters were put up on post office property or other unlawful places I could understand an investigation but to anyone who has driven in a more populated area and seen the posters, signs and garbage posted on underpasses and any other flat space this is over the top..KD

Clermont police interview suspect in Obama 'Joker' posters

CLERMONT

Clermont police have interviewed one suspect who is admitting to putting up the dozens of posters pasted around the city depicting President Obama as the Joker character from the Batman film The Dark Knight, city officials confirmed.

Assistant City Manager Darren Gray said city officials have an individual "admitting to putting up 500" of the posters.

Clermont Police Capt. Eric Jensen said the male individual has admitted to putting up some signs, but investigators suspect others were involved and their investigation is continuing.

"We have talked to an individual," Jensen said. "He only admitted to some of it...We're still tracking down leads and talking to folks. We have not arrested anybody."

At this point officials are not sure how much damage was caused by the signs or the dollar amount associated with the clean-up.

Dozens of the posters were pasted around the city earlier this week. A pair of the posters were pasted to a Clermont Post Office collection box. They prompted the postmaster to contact the Postal Inspector's office, which is looking at potential federal crimes for defacing federal property.

City officials, meanwhile, are trying to determine what local crimes might be associated with the posting of the images on public and private properties. They've also been busy ripping down the sticky signs because they're a violation of city ordinance regarding illegal signs.

Jensen said he doesn't have a good count on the number of posters put up because, he said, "People are going out and tearing them down."

In a press release put out late today, Jensen said the suspect "also asked if he could video tape the encounter with the officers." Clermont Police declined that request.

"Currently we are still conducting interviews of victims, witnesses, and other suspects who were placing the Obama Joker Poster throughout our city," Jensen said in the statement. "We believe that the postings are the result of multiple suspects. We are hopeful that we can develop enough information to present charges of vandalism to the State Attorney's Office for review."

He did not have a specific reason why the individual who admitted to putting up the posters spent so much time sticking them to surfaces around the city, but Jensen suspects it may have something to do with a contest linked to the image of the President in white face and smeared lipstick, like the Joker.
