Official who oversaw ballots in 2008 race says hospital birth certificate non-existent

Tim Adams was a senior elections clerk in Honolulu, says there was no birth certificate on record.
     A college instructor who worked as a senior elections clerk for the city and county of Honolulu in 2008 is making the stunning claim Barack Obama was definitely not born in Hawaii as the White House maintains, and that a long-form, hospital-generated birth certificate for Obama does not even exist in the Aloha State.
    Tim Adams, a former senior elections clerk for Honolulu, now teaches English at Western Kentucky University.
     "There is no birth certificate," said Tim Adams, a graduate assistant who teaches English at Western Kentucky University in Bowling Green, Ky. "It's like an open secret. There isn't one. Everyone in the government there knows this."
    Adams, who says he's a Hillary Clinton supporter who ended up voting for John McCain when Clinton lost the Democratic nomination to Obama, told WND, "I managed the absentee-ballot office. It was my job to verify the voters' identity."
    He says during the 2008 campaign when the issue of Obama's constitutional eligibility first arose, the elections office was inundated with requests to verify the birthplace of the U.S. senator from Illinois.
     "I had direct access to the Social Security database, the national crime computer, state driver's license information, international passport information, basically just about anything you can imagine to get someone's identity," Adams explained. "I could look up what bank your home mortgage was in. I was informed by my boss that we did not have a birth record [for Obama]."
     At the time, there were conflicting reports that Obama had been born at the Queen's Medical Center in Honolulu, as well as the Kapi'olani Medical Center for Women and Children across town. So Adams says his office checked with both facilities.
     "They told us, 'We don't have a birth certificate for him,'" he said. "They told my supervisor, either by phone or by e-mail, neither one has a document that a doctor signed off on saying they were present at this man's birth."
To date, no Hawaiian hospital has provided documented confirmation that Obama was born at its facility.

     WND confirmed with Hawaiian officials that Adams was indeed working in their election offices during the last presidential election.
     "His title was senior elections clerk in 2008," said Glen Takahashi, elections administrator for the city and county of Honolulu.
     Takahashi also confirmed Adams' time frame at the office from spring until the month of August.
"We hire temporary workers, because we're seasonal," he said.
     However, when WND asked Takahashi if the elections office could check on birth records, he said, "We don't have access to that kind of records. [There's] no access to birth records."
     Adams responded, "They may say, 'We don't have access to that.' The regular workers don't, the ones processing ballots; but the people in administration do. I was the one overseeing the work of the people doing the balloting."
     Adams stressed, "In my professional opinion, [Obama] definitely was not born in Hawaii. I can say without a shadow of a doubt that he was not born in Hawaii because there is no legal record of him being born there. If someone called and asked about it, I could not tell them that person was born in the state."
     The White House has maintained a computer-generated Certification of Live Birth, or COLB, is proof enough of Obama's Hawaiian birth, even though it has no hospital or doctor's name on it. Such documents differ from a Certificate of Live Birth which includes those details. In response to a direct question from WND, the Hawaii Department of Health refused to authenticate either of the two versions of Obama's short-form COLB, posted online – neither the image produced by the Obama campaign nor the images released by FactCheck.org.

This short-form Certification of Live Birth image, which is not the same as a long-form, hospital-generated Certificate of Live Birth, was released by the Obama campaign June 2008.

     "Anyone can get that [COLB]," said Adams. "They are normally given if you give birth at home or while traveling overseas.  We have a lot of Asian population [in Hawaii]. It's quite common for people to come back and get that."
     When WND mentioned there were announcements of Obama's birth published in Hawaiian newspapers, Adams noted, "I'm sure the [maternal] grandparents were happy to put that in the paper when he got born."
     But Adams says that doesn't necessarily mean he was actually born in Hawaii. While he's not 100 percent sure of Obama's true birthplace, he does think Kenya is a possibility, since his paternal grandmother stated that before allegedly being silenced by other family members.

Gov. Linda Lingle, R-Hawaii

     Last month, as WND reported, Hawaii's Republican Gov. Linda Lingle reignited Obama's origin on a New York radio show.
     "It's been an odd situation," Lingle said. "This issue kept coming up so much in the campaign, and again I think it's one of those issues that is simply a distraction from the more critical issues that are facing the country.
     "So I had my health director, who is a physician by background, go personally view the birth certificate in the birth records of the Department of Health, and we issued a news release at that time saying that the president was, in fact, born at Kapi'olani Hospital in Honolulu, Hawaii. And that's just a fact and yet people continue to call up and e-mail and want to make it an issue and I think it's again a horrible distraction for the country by those people who continue this."
     Although the governor now claims she issued a news release stating Kapi'olani is Obama's birthplace, the actual release said no such thing, making no reference to Kapi'olani nor any other specific location of Obama's birth.
     WND asked Adams why the governor would make such assertions if a Hawaiian hospital-generated birth certificate did not exist.
     "Why would they say they've seen it and not produce it? I don't know," he said. "If they said they've seen the document, then why not produce the document? There's no need to put themselves out like that. I can't even begin to think why they did that except for some kind of political expediency. I'm too far down the totem pole [to know]."
     While Adams, who noted he spent nearly 10 years in the islands and has a bachelor's degree from the University of Hawaii, says he's certain Obama was not born there, he also does think the president is indeed a U.S. citizen, since his mother, Stanley Ann Dunham was an American.
     He says he merely would like to see the truth come out and have the controversy over natural-born citizenship and presidential eligibility resolved once and for all.  "It's come to the point where it's a monster, and it's time to kill it," Adams said. "Solve the problem so that everyone can get back to cooperating to improve the country. People have lost sight that we're trying to make the country a better place."
     He also feels some empathy for Obama, foreseeing what the president would potentially experience based on confirmation of his claims.
     "You don't have to like President Obama," he said, "but it is sad that he's going to have to go through this public pillory by the time this all comes out, that they did cover this up; and that's sad because the first African-American man to become president shouldn't have this blight on his term in office. That's what he'll get remembered for. It's sad."
Adams says he's been telling other people his information for a long time, and he's free to talk about it publicly since he no longer has any confidentiality restrictions from his former employer, the Honolulu government. People started to pay attention this week after he was briefly interviewed by James Edwards, host of a weekly radio show on WLRM Radio in Memphis, Tenn.
     As WND reported last July, the Kapi'olani Medical Center trumpeted – then later concealed – a letter allegedly written by President Obama in which he ostensibly declares his birth at the facility.

A photograph taken by the Kapi'olani Medical Center for WND shows a letter allegedly written by President Obama on embossed White House stationery in which he declares the Honolulu hospital to be "the place of my birth," The hospital, after publicizing the letter then refusing to confirm it even existed, is now vouching for its authenticity, but not its content. The White House has yet to verify any aspect of the letter.

     "As a beneficiary of the excellence of Kapi'olani Medical Center – the place of my birth – I am pleased to add my voice to your chorus of supporters," Obama purportedly wrote:  "The Kapi'olani Medical Center - the place of my birth."

This excerpt from the alleged Obama letter is perhaps the first formal declaration from the president about his exact birthplace. The White House has still not confirmed if the letter or its contents are authentic.

     But the authenticity of that letter remains in doubt. Since WND raised questions about the veracity of the letter itself and its content, the White House has refused to say if the message is real and if its text originated with the president.
     When WND correspondent Les Kinsolving asked Press Secretary Robert Gibbs about the letter at the July 13 news briefing, Gibbs dodged the question, refusing to confirm its authenticity while belittling Kinsolving for even posing the question.

     "Do all of your listeners and the listeners throughout this country the service to which any journalist owes those listeners, and that is the pursuit of the noble truth," Gibbs lectured Kinsolving. "And the noble truth is that the president was born in Hawaii, a state of the United States of America."
     Since the medical center used the letter for a high-profile fundraising campaign in the Spring 2009 edition of its Inspire Magazine, the FBI and United States Secret Service said the matter could potentially lead to criminal prosecution were the letter determined to be fraudulent.
     "It would be a charity-fraud scheme," said FBI spokesman Steve Kodak. "It would be investigated by us or the Secret Service. We both have jurisdiction over that."
     WND also revealed the discovery by private investigators who say Obama is mysteriously using a Social Security Number that was issued in Connecticut, despite having worked in Hawaii as a teen and there being no mention of him living in Connecticut.
     Meanwhile, Hawaii continues to get requests for release of Obama's hospital-generated birth certificate, leading state lawmakers to take action.
     They passed a bill in April allowing any Hawaii department to ignore repeated inquiries for information from the same person, if the department already has responded within a year. Gov. Lingle signed it into law shortly after WND's report about her declaration on radio that Obama was born at Kapi'olani.

Publishing Company Under Fire for Putting Warning Label on Constitution

    A small publishing company is under fire after putting warning labels on copies of the U.S. Constitution, Declaration of Independence and other historical documents.
    Wilder Publications warns readers of its reprints of the Constitution, the Declaration of Independence, Common Sense, the Articles of Confederation, and the Federalist Papers, among others, that “This book is a product of its time and does not reflect the same values as it would if it were written today.”
    The disclaimer goes on to tell parents that they "might wish to discuss with their children how views on race, gender, sexuality, ethnicity, and interpersonal relations have changed since this book was written before allowing them to read this classic work."
    Walter Olson, senior fellow at the Cato Institute, says the company may be trying to ensure that oversensitive people don't pull its works off bookstore or library shelves.
    "Any idea that’s 100 years old will probably offend someone or other," Olson told FoxNews.com. "…But if there’s anything that you ought to be able to take at a first gulp for yourself and then ask your parents if you're wondering about this or that strange thing, it should be the founding documents of American history."

    The preening liberal media loves to fancy itself an elite bunch, the epitome of correct thinking, good intention, and unassailable virtue. That comfortable notion took a broadside earlier this week when it became known that liberal icon Helen Thomas had remarked Jews should "get the hell out of Palestine" and "go home" to Germany or Poland.
    It should be noted that Thomas was well-known for her anti-Israeli views, often peppering administration officials with long-winded questions that came across as pro-Palestinian tirades.
    But Helen Thomas isn't the only female journalist who recently indulged in bald stereotypes.
    Last Thursday journalist Andrea Mitchell channeled her inner psychologist, pontificating on the causes of American wars. And Mitchell came to the conclusion that war, for all its complexity, its ebbs and flows, its bravery and tragedy, could be boiled down to a single word: "testosterone."
    The context was an Andrea Mitchell Reports interview with historian Evan Thomas about his recent book, The War Lovers. Casting aside historical nuance, this is what Ms. Mitchell had to say.
    "And it is men — not to be too gender specific here — but there, there is a male factor here... I've we seen it in our own recent history. What is it about testosterone that gets us into war?"

The deepening notes of disenchantment with Barack Obama now issuing from commentators across the political spectrum were predictable. So, too, were the charges from some of the president's earliest enthusiasts about his failure to reflect a powerful sense of urgency about the oil spill. There should have been nothing puzzling about his response to anyone who has paid even modest critical attention to Mr. Obama's pronouncements. For it was clear from the first that this president single-minded, ever-visible, confident in his program for a reformed America saved from darkness by his arrival was wanting in certain qualities citizens have until now taken for granted in their presidents. Namely, a tone and presence that said: This is the Americans' leader, a man of them, for them, the nation's voice and champion. Mr. Obama wasn't lacking in concern about the oil spill. What he lacked was that voice and for good reason. Those qualities to be expected in a president were never about rhetoric; Mr. Obama had proved himself a dab hand at that on the campaign trail. They were a matter of identification with the nation and to all that binds its people together in pride and allegiance. These are feelings held deep in American hearts, unvoiced mostly, but unmistakably there and not only on the Fourth of July. A great part of America now understands that this president's sense of identification lies elsewhere, and is in profound ways unlike theirs. He is hard put to sound convincingly like the leader of the nation, because he is, at heart and by instinct, the voice mainly of his ideological class. He is the alien in the White House. One of his first reforms was to rid the White House of the bust of Winston Churchill a gift from Tony Blair by packing it back off to 10 Downing Street. A cloudlet of mystery has surrounded the subject ever since, but the central fact stands clear. The new administration had apparently found no place in our national house of many rooms for the British leader who lives on so vividly in the American mind. Churchill, face of our shared wartime struggle, dauntless rallier of his nation who continues, so remarkably, to speak to ours. For a president to whom such associations are alien, ridding the White House of Churchill would, of course, have raised no second thoughts.

SPIEGEL ONLINE: Mr. Ellsberg, you're a hero and an icon of the left. But we hear you're not too happy with President Obama anymore. Daniel Ellsberg: I voted for him and I will probably vote for him again, as opposed to the Republicans. But I believe his administration in some key aspects is nothing other than the third term of the Bush administration. SPIEGEL ONLINE: How so? Ellsberg: Take Obama's explicit pledge in his State of the Union speech to remove "all" United States troops from Iraq by the end of 2011. That's a total lie. I believe that's totally false. I believe he knows that's totally false. It won't be done. I expect that the US will have, indefinitely, a residual force of at least 30,000 US troops in Iraq.

Call for Obama's resignation cites 'deceit, fraud, dishonesty'

A retired U.S. military leader who now is a presence on the Internet with his Stand Up For America and Veterans Defenders websites has issued a call for President Obama's resignation and a new election to replace him. The call comes from Maj. Gen. Paul E. Vallely, who served in Vietnam and retired in 1991 from the U.S. Army as deputy commanding general for the Pacific. "We now must call for the immediate resignation of Barry Soetero (AKA President Barack Hussein Obama) � based on incompetence, deceit, fraud, corruption, dishonesty and violation of the U.S. oath of office and the Constitution," he said in remarks delivered to a Lincoln Reagan dinner in Virginia City, Mont., last week and published today on the Stand Up America website. "And a call for a national petition for new elections to select the next president of the United States of America must be initiated," he continued. "We can wait no longer for a traditional change of power and new government." A number of retired military members have sought the removal of Obama from office. They mostly have tried to utilize the courts to challenge his eligibility based on claims he fails to meet the U.S. Constitution's requirement that a president be a "natural born citizen." Few have asserted Obama needs to walk away from the Oval Office for the best of the nation.

Reporters attend pool party with Joe Biden

Imagine that while a slick death spreads across the Gulf of Mexico, a group of respected reporters from America's best-known media companies attend a pool party hosted by the VP of British Petroleum. Imagine that they take their kids to play with the kids of executives from BP and the oil industry, and that the journalists claim to have had a wonderful time and post pictures, and videos and tweets of their perfectly friendly interactions with the people who are responsible for the greatest environmental catastrophe in a generation. Now imagine those journalists, a few days after the party, claiming that their integrity had not been compromised, and that they are perfectly capable of reporting accurately and aggressively on the doings of BP and the oil industry. Would you believe them? Hold on to that answer, and consider this: No such meeting happened with BP. But on the grounds of the Naval Observatory last weekend, Vice President Joe Biden and the DNC hosted a pool party for their friends in the Washington journalism industry. It was a nice way to spend a hot Saturday afternoon,  according to the Atlantic's Marc Ambinder. It was also a great way for the journalists in attendance  - Wolf Blitzer and Ed Henry of CNN, as well as David Sanger of the New York Times - to reveal that their integrity is water soluble.

Misdemeanors – or crimes?

On this matter of offering federal jobs to potential candidates to induce them not to run against Senate Democratic incumbents, this White House is drifting dangerously close to the falls. Colorado's Andrew Romanoff has now confirmed that White House Deputy Chief of Staff Jim Messina trolled three federal jobs in front of him, if he would desist and not run against incumbent Sen. Michael Bennet. And Romanoff has produced an e-mail where Messina presents the three-job menu, one of which might be his if he passed up the Senate run. Two were with the Agency for International Development. The third was director of the U.S. Trade and Development Agency. All three are juicy plums. Romanoff and Messina both say no hard offer was made. And Robert Gibbs has assured the press the president had no idea Messina was talking to Romanoff about federal jobs that only Obama can fill. But if Obama knew nothing of the Messina-Romanoff talks, who did? For Messina cannot appoint anyone to anything. Has Messina's boss, Rahm Emanuel, been given the franchise to offer a dessert tray of federal jobs to people he wants to keep out of Democratic primaries? An independent investigation needs to be conducted to determine whether Chicago-style politics has been introduced into the West Wing.

How Obama Reduced Crime Rates Last Year

President Obama surely didn’t intend it, but he deserves some credit for last year’s 7.4 percent drop in murder rates. His election caused gun sales to soar, and crime rates to plummet. While gun sales started notably rising in October 2008, sales really soared immediately after Mr. Obama won the presidential race. 450,000 more people bought guns in November 2008 than bought them in November 2007, that’s over a 40 percent increase in sales. By comparison, the change from November 2006 to November 2007 was only about 35,000. Over the last decade, the average year-to-year increase in monthly sales was only 21,000. The increase in sales continued well beyond November 2008. From November 2008 to October 2009, almost 2.5 million more people bought guns in the 12 months after the election than in the preceding 12 months. The National Instant Criminal Background Check System, or NICS, doesn’t tell us how many guns each person bought just the number of people who bought them. Most likely though, gun sales rose by more than the number of people who purchased them. At the same time gun sales were soaring, there was an unusually large drop in murder rates. The 7.4 percent drop in the murder rate was the largest drop in murder rates since the 1999. For those who don’t remember, 1999, when President Bill Clinton and Columbine occurred, was another time when gun sales soared. With people such as Elena Kagan serving as Mr. Clinton’s deputy domestic policy adviser were pushing hard for more gun control, Americans were worried that more gun bans were coming. And in response gun sales soared.

74% Oppose Taxing Internet News Sites To Help Newspapers

The Federal Trade Commission (FTC) is considering several ways to help the struggling newspaper industry, but Americans strongly reject several proposed taxes to keep privately-owned newspapers going. A new Rasmussen Reports national telephone survey finds that 84% oppose a three percent (3%) tax on monthly cell phone bills to help newspapers and traditional journalism. Similarly, 76% oppose a proposed five percent tax on the purchase of consumer electronic items such as computers, iPads and Kindles to help support newspapers and traditional journalism. Seventy-four percent (74%) oppose the proposal to tax web sites like the Drudge Report to help the newspapers they draw their headlines from. Each of these ideas was suggested for consideration in a recent FTC report. Only 10% favor the tax on monthly cell phone bills to help newspapers and traditional journalism. Sixteen percent (16%) support the tax on consumer electronic devices, and 18% of Adults favor placing an additional tax on Internet news sites.

Obama lashes BP chief, media over oil disaster

President Barack Obama said he would fire BP CEO Tony Hayward for flippant comments and lashed out at media "talking heads," ratcheting up his rhetoric on the 50th day of the US oil disaster. As Obama Tuesday apparently sought to contain further political damage over the greatest environmental calamity in US history, his top disaster aide reported more progress capturing oil spewing from a ruptured undersea well. Hayward, whose sardonic English tones and comments, including a prediction that the Gulf spill would be "very, very modest," have irked some Americans, found himself directly in Obama's cross-hairs. "He wouldn't be working for me after making any of those statements," Obama said on the NBC "Today Show" program, following criticism his public anger has been too tepid. Hayward has since apologized for his remarks. Obama also revealed that he had not personally spoken to Hawyard, since an explosion on the BP-operated Deepwater Horizon rig on April 20, saying there would be little point.

A U.S. Army flight surgeon who posted a video indicating his complete rejection of all orders from the military unless Barack Obama documents his eligibility to occupy the Oval Office is now refusing an "unofficial" suggestion from the Army for a medical evaluation.

Lt. Col. Terry Lakin is the highest-ranking and first active-duty officer to refuse to obey orders based on President Obama's eligibility.

WND reported this week the Army was hinting that Lt. Col Terry Lakin should undergo a brain scan and medical review.

A spokeswoman involved with the developing case said the recommendation was delivered to Lakin by an unnamed officer who implied those higher up the chain of command thought it was a good idea.

The suggestion was described to WND by spokeswoman Margaret Calhoun Hemenway, a veteran Washington appointee and now volunteer spokeswoman, as being presented in a "solicitous" manner.

Officially, the U.S. Army says it has no plans for formal action at this point against the officer. But Calhoun Hemenway told WND that Lakin's "no" meant "no."

"He is not taking any suggested medical evaluation or brain scan. He is refusing to obey all orders including deployment orders," she confirmed.

"It is interesting this suggestion of a medical exam should arise now given he was only a couple of weeks from deployment and obviously judged to be fit for deployment with his bags packed," she said.

But as WND reported, the controversy raises the prospect that the government may be unwilling to pursue a prosecution because of the possible ramifications – which could include a defense lawyer's demand for a court-ordered discovery process that would target Obama's historical documentation

Even participants in a forum on the left-leaning Huffington Post website seemed to agree in part.

Freakin' Brilliant!" said one. "They can't court-martial him [without] the defense getting the judge to order the the (sic) birth-certificate be produced! Either Obama will have to produce or they can't prosecute. Genius."

Another forum page poster on the same site said the military of days gone by never would have allowed such statements.

"During my military service within the Army (in the 1970s, 80s and 90s) before retirement, this type of behavior would NEVER have been tolerated and most of all, would never have made the MSM news cycle. That's because Larkin (sic) would be immediately remanded for a general court-martial and would likely face pretrial confinement by the first general officer within his chain-of-command."

"It's troubling that the Army has not prosecuted this man immediately instead of making an MSM event out of it."

Army Dr. Terry Lakin, the flight surgeon for 3rd Squadron, 4th Cavalry Regiment, examines the partially amputated finger of an Afghan man who assists in collecting unexploded ordnance at Kandahar Airfield. Lakin was selected as the Army Medical Department's Flight Surgeon of the Year for 2004.

As WND reported, Lakin is an active-duty flight surgeon charged with caring for Army Chief of Staff Gen. George Casey's pilots and air crew.

He said he's refusing all orders until Obama releases his long-form, hospital-generated birth certificate to prove his eligibility to serve as commander in chief.

"I feel I have no choice but the distasteful one of inviting my own court martial," Lakin said in a statement. "The Constitution matters. The truth matters."

He continued, "For the first time in all my years of service to our great nation, and at great peril to my career and future, I am choosing to disobey what I believe are illegal orders, including an order to deploy to Afghanistan for my second tour of duty there. I will disobey my orders to deploy because I – and I believe all servicemen and women and the American people – deserve the truth about President Obama's constitutional eligibility to the office of the presidency and the commander in chief.

"If he is ineligible, then my orders – and indeed all orders – are illegal because all orders have their origin with the commander in chief as handed down through the chain of command."

Lakin is not the first active-duty officer to raise the challenge. Others have included Army doctor Capt. Connie Rhodes and Army reservist Maj. Stefan Cook. But Lakin is the highest-ranking officer to raise the question.

In a statement yesterday to WND, George Wright of Army Public Affairs said the Army has "no reaction" to Lakin's statements, and "at this point, the Army will take no formal action."  He said, "Lt. Col. Lakin has stated his intent to violate Articles 87 and 92 of the Uniform Code of Military Justice, but has not done so. Whether his actions to date violate any law or policy is for his chain of command to determine."

Wright said the Army had no information on in-channel concerns Lakin reported raising twice during 2009. There was "no comment" on whether Obama needs to document his eligibility to serve as president under the U.S. Constitution's requirement that the commander in chief be a "natural born citizen."

Although a "natural born citizen" is undefined in the Constitution, many legal analysts believe the requirement was put there to prevent dual allegiances on the part of the president. Some believe those with dual citizenship would be ineligible. Obama wrote in his book his father was a subject to the United Kingdom, making Obama likely a dual citizen.

"Lt. Col Lakin is free to express his personal views. The Army has no comment on his concerns, nor the views that he espoused," Wright told WND.

But the background already has been assembled in the case, should there be a prosecution, for the defense to come to court with specific demands for proof of the validity of the chain of command, up to the commander in chief.

Support for Lakin is being generated at the Safeguard Our Constitution.com website,established by the American Patriot Foundation.

One of the organizers behind the group, serving in emeritus status, is John Hemenway, an attorney who previously fought in the U.S. court system on behalf of a retired military officer, Gregory S. Hollister, who also questioned Obama's eligibility.

The case ultimately was dismissed by Judge James Robertson who ruled that the dispute had been "twittered" during the 2008 election campaign.

In that opinion, Robertson sarcastically wrote: "The plaintiff says that he is a retired Air Force colonel who continues to owe fealty to his commander in chief (because he might possibly be recalled to duty) and who is tortured by uncertainty as to whether he would have to obey orders from Barack Obama because it has not been proven – to the colonel's satisfaction – that Mr. Obama is a native-born American citizen, qualified under the Constitution to be president.

"The issue of the president's citizenship was raised, vetted, blogged, texted, twittered, and otherwise massaged by America's vigilant citizenry during Mr. Obama's two-year-campaign for the presidency, but this plaintiff wants it resolved by a court," Robertson wrote.

The judge also suggested sanctions against Hemenway for bringing the case, and Hemenway responded that process then would provide him with a right to a discovery hearing to see documentation regarding the judge's statements – not supported by any evidence introduced into the case – that Obama was properly "vetted."

Hemenway warned at the time, "If the court persists in pressing Rule 11 procedures against Hemenway, then Hemenway should be allowed all of the discovery pertinent to the procedures as court precedents have permitted in the past.

"The court has referred to a number of facts outside of the record of this particular case and, therefore, the undersigned is particularly entitled to a hearing to get the truth of those matters into the record. This may require the court to authorize some discovery," Hemenway said.

WND columnist Vox Day earlier wrote about this very scenario, calling it a "Get out of war" free card.

The comments followed the case of Cook, the reservist who challenged his deployment orders over questions about their legality under Obama.

"Rather than contesting the suit," Day wrote, "the Army took the highly peculiar step of revoking the major's deployment order, suggesting that the Pentagon generals are not entirely confident that they can demonstrate the legitimacy of their purported commander in chief.

"The Pentagon's decision to back down rather than risk exposing Obama's birth records to the public means that every single American soldier, sailor, pilot and Marine now holds a 'get out of war free' card. Not only every deployment order, but every order issued from an officer in the line of command can now be challenged in the knowledge that the top brass are afraid to respond for fear that their commander could be exposed for a fraud.," he wrote at the time.

"It is one thing for Obama to deny the curiosity of the American public by hiding behind the courts. It is very much another for him to deny the right of the men and women of the Army, Navy, Air Force and Marines, who are sworn to risk their lives upholding the Constitution of the United States of America, to be certain their orders are legitimate," he said.

Calhoun Hemenway, who separately writes for FamilySecurityMatters.org, told WND she is an unofficial spokeswoman for the case and that Lakin's legal counselors have suggested he not comment a great deal at this point while he is on leave and before he returns to his duties.

Calhoun Hemenway, a former White House appointee serving in the Department of Defense and at NASA, said the Lakin case presents a problem for the Army, since it cannot simply "rescind" orders as it has in previous military disputes over orders under Obama's chain of command. That's because Lakin has indicated plans to reject all orders.

In his video message now posted on YouTube, Lakin, an 18-year veteran, personally pleads with the president to stop withholding the key document which would put to rest many of the doubts that continue to linger more than a year into Obama's term.

"President Obama, I ask you to respect and uphold the Constitution. Be transparent and show your honesty and integrity. Release your original, signed birth certificate, if you have one, thus proving your birth on American soil, and thus assure the American people that you are lawfully eligible to hold the office of the presidency and serve as commander in chief of the Armed Forces."

Obama's actual response to those who question his eligibility to be president under the Constitution's requirement that the U.S. president be a "natural born citizen" has been to dispatch both private and tax-funded attorneys to prevent anyone from gaining access to his documentation.

Besides Obama's actual birth documentation, the still-concealed documentation for him includes kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, passport, medical records, his files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records, and his adoption records.

WND has reported on a multitude of cases that have been brought over the issue of Obama's eligibility. Some are by critics who have doubts about whether he was born in Hawaii in 1961 as he has written, and others are from those who question whether the framers of the Constitution specifically excluded dual citizens – Obama's father was a subject of the British crown at Obama's birth – from being eligible for the office.

The issue has prompted a number of state legislatures to work on proposals that would require presidential candidates to submit proof of their eligibility. And a similar proposal has been introduced in Congress by Rep. Bill Posey, R-Fla.

The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

However, none of the cases filed to date has been successful in reaching the plateau of legal discovery, so that information about Obama's birth could be obtained.  The White House has not replied to numerous requests for comment.

Because of the dearth of information about Obama's eligibility, WND founder Joseph Farah has launched a campaign to raise contributions to post billboards asking a simple question: "Where's the birth certificate?"

The campaign followed a petition that has collected more than 498,000 signatures demanding proof of his eligibility, the availability of yard signs raising the question and the production of permanent, detachable magnetic bumper stickers asking the question.

The "certification of live birth" posted online and widely touted as "Obama's birth certificate" does not in any way prove he was born in Hawaii, since the same "short-form" document is easily obtainable for children not born in Hawaii. The true "long-form" birth certificate – which includes information such as the name of the birth hospital and attending physician – is the only document that can prove Obama was born in Hawaii, but to date he has not permitted its release for public or press scrutiny.

Oddly, though congressional hearings were held to determine whether Sen. John McCain was constitutionally eligible to be president as a "natural born citizen," no controlling legal authority ever sought to verify Obama's claim to a Hawaiian birth.
