THE TAX-YOUR-DRIVING IDEA MAY BE LOOKING BETTER TO OBAMA - A MILEAGE TOLL.
      Senate Budget Committee Chairman Kent Conrad (D-ND) is still trying to figure out a way for the government to make money off of U.S. drivers as if they were a distinct breed of citizens disassociated with the term "taxpayer." For the fourth time in half as many years, he raised the issue of a Vehicle Mileage Traveled (VMT) in a March, 2011 Congressional Budget Office report. Things are tough everywhere. And government's pockets are hurting as badly as the taxpayers'.
     Add to the shrinking tax base 1,500,000 more unemployed Americans than we had when Barack Obama started passing out stimulus money like penny candy to the needy, and it's easy to see why the Obama Administration is fishing for new ways to generate tax revenue without calling their new ideas taxation. After all, on Sept. 12, 2008, Candidate Barack Hussein Obama said: "Under my plan, no family making less than $250 thousand a year will see any form of tax increase. Not your income tax. Not your payroll tax. Not your capital gains taxes. Not any of your taxes."
     Bad ideas have a perpetual life in Washington. This bad idea began as a way to sell drivers on buying hybrid vehicles. While it was bantered about during both Bush administrations, it was seriously proposed by Congressman James Oberstar [D-MN] in 2009. The idea? A tax for every mile you drive. The people of Minnesota liked the idea so much they replaced Oberstar with a Republican, Chip Cravaack, in 2010. The second person to suggest it was Obama Transportation Secretary Ray LaHood (before the 2010 election). Obama shot the idea down. That's a good way to lose seats.
     That was then. This is now. Like I said, bad ideas have perpetual life inside the beltway. They never die. Politicians simply put them in a new set of clothes and trot them out every time they get desperate for increased tax revenues - and Washington hasn't been this desperate since the Great Depression.
     The month of May was a different story. That bad idea was looking better to someone, because a draft transportation authorization bill was floated on May 2. Section 2218 of that bill would create, within the Federal Highway Administration, a Surface Transportation Revenue Alternatives Office that would be tasked with creating a sturdy framework that defines the functionality of a mileage-based user fee system. Obama was floating a trial balloon.
     How will the tax work? At this point, it doesn't matter. What matters is that the Obama Administration, which has said, four times, it is not considering a VMT (mileage tax on travelers), is considering a mileage tax. How they plan to implement it isn't as important as how much it's going to cost YOU for them to track how many miles you drive. And, of course, how and when you are expected to pay to travel over America's highways that your tax dollars built.
     On every level, this is a nightmare the American people will flatly reject. Remind Congress that if they vote to tax the miles we drive, there's going to be a lot of former Congressmen and Senators riding the bus in January, 2013.
     The idea of taxing motorists for the miles they drive, known as a Vehicle Miles Traveled (VMT) Tax has been discussed in Washington for several years. One such dialogue took place during the Bush-43 years. The Obama Administration has not officially signed on to the idea, but Obama requested $20 million in 2012 budget to establish the Surface Transportation Revenue Alternative Office. When questioned about the VMT Tax (or Toll as it will likely be called) Department of Transportation spokeswoman Jill Zuckerman said that the proposed Office is being charged with analyzing a range of alternatives, not just one, thus the DOT has not proposed any new revenue model at this time.
     The fact remains that while Obama has not used his bully pulpit to advocate a VMT Tax, by taking the step toward creating this office, and doing the exploratory work on how to achieve this goal - particularly since the VMT tax is the preferred policy option of several transportation experts - expect its covert implementation to happen. When they unveil it, as a "toll" and not a tax, Obama will sign it into law.
     The VMT Tax will not just be a public relations bad green dream, it will be a political nightmare on every imaginable policy level. The United States of America already has an effective taxing system that is based on how much you earn. We don't need one that's based on how far you drive. Today, as Obama ponders a VMT tax, his car company - General Motors - has suggested that Congress slap a $1 per gallon environmental surcharge tax on gasoline to put the United States more in line with what Europeans pay for gasoline. In GM's mind, that would help bolster sales of GM's albatross, the electric GM Volt.
     Is this merely a push to get people to buy hybrid cars? I don't think so. I think this is a tax revenue-hungry government looking for a new food source. Here's the reality. U.S. citizens should not be charged a travel tax to take their kids to school, go to and from work, see a doctor, go grocery shopping, take their spouse or date out to dinner and a movie, or just take a leisurely weekend drive in the country. While it is now starting to not look much like the America I grew up it, I believe this is still America.
      Is this merely an environmentalist devise, through taxation, to make more people use public transit? The Federal Highway Administration website offered an explanation. The FHA said that the proposed office will phase in research and demonstration efforts to analyze a range of revenue generation alternatives with the potential to replace the petroleum-based system currently used to fund surface transportation programs.
     During the Bush-43 years, a 2006 report commission by the Dept. of Transportation called the mileage tax the most promising technique for directly assessing users for the costs of individual trips within a comprehensive fee scheme that will generate revenue to cover the costs of highway programs.
     Politicians who think differently than the rest of us seem to think the mileage tax is more equitable than a gasoline tax. Senator Kent Conrad dismissed that myth in the Senate's March, 2011 report in which the conclusion reached was that highway financing was best accomplished through a combination of BOTH gasoline taxes and mileage taxes. It's not one or the other. It's both.
      On page 91 of the 2009 National Surface Transportation Infrastructure Financing Commission Study (created by the Democratically-controlled House and Senate), the report concluded that the most viable approach [for financing highways] is based directly on miles driven (commonly referred to as a Vehicle Miles Traveled [VMT] fee system. The report added that a 3.3 cents per mile charge could raise $1 billion annually. For a car that travels 15,000 miles a year, the cost would be $495 a year. That report suggested Congress was considering replacing gasoline taxes will a mileage tax.
     How much would your Vehicle Mileage Traveled tax be? How many miles did you drive last year? Multiply those miles by 3.3 cents. That's likely what you will be paying after the politicians get through posturing. If you are the government, and you have a penchant - and a need - for a new revenue stream, you don't spend millions of dollars to figure out how to assess and collect a new form of taxation, and not collect it.
      On May 5, The Hill reported that White House spokeswoman Jennifer Psaki rebutted The Hill's query about Obama supporting a VMT tax saying a plan to tax automobile drivers by the mile isn't an option under consideration. On May 9, she modified her statement admitting that the VMT tax scheme was a draft memo for legislation, but that it was not "formally" circulated in the White House.
     With all the back and forth bantering by the White House that Barack Obama is not considering a VMT tax, logic says he is. The Obama Administration and what the public increasingly calls Government Motors have made a commitment to electric cars. While the current models are hybrids that rely more on gasoline than electricity, clearly the auto industry expects that each year the vehicles produced will rely less on gasoline and more electricity.
     As the motor vehicles we use consume less gasoline, the government will receive fewer gasoline tax dollars. Since the government, and the auto industry which is now - thanks to Obama - partially owned by the nation's labor unions, believe electric cars will be the dominant personal transportation of the future, they need to find a way to tax the fuel they consume sufficiently enough to replace the gasoline tax revenues they expect to lose. Thus, Conrad was correct in his assessment that highway financing requires both gasoline taxes and a VMT tax - a tax today for the future.
     The proposal the Obama Administration includes what the DOT calls "other options." Options which include converting bridges and highways into revenue-generating toll roads although VMT is viewed by most as the best choice because it is considered to be the most reliable funding source.
     The United States has an effective way to generate revenues to keep up America's highway system. It's called a gas tax. While Americans don't like paying 36 cents in taxes for every gallon of gas they pump into their gas-powered vehicles, they are going to be even more unhappy about paying a Vehicle Miles Traveled tax.
     Eliminating wasteful spending of taxpayer dollars should be this Administration's first priority rather than spending millions of dollars devising new ways to tax the American people.

o'cap'n tax - Nat.Avg/gal=$3.999 .. Fuel Prices aren't all that's o'inflated!

This is $1.07 per gallon higher than last year at this time and is the highest price in May since EIA began tracking weekly data in 1990!  .. Reid Celebrates Obama's Yucca Mountain Decision

Senate Majority Leader Harry Reid reports in a message to Nevadans that President Obama has ended the government's bid to store nuclear waste in Yucca Mountain and that instead, Obama will try to come up with another plan. On his Senate website, Reid reports:

Dear Fellow Nevadan-

Today was an extremely important day in our fight against the proposed nuclear waste dump at Yucca Mountain. In his budget request for 2010, President Obama will announce plans to devise a new strategy to find another solution to deal with the nation's nuclear waste that does not include storing it in Nevada .

As Nevadans know, I have been successfully fighting the proposed Yucca Mountain nuclear waste dump since I began my career in the Senate. I have had tremendous help from our state's leaders and thousands of Nevadans along the way. President Obama joined the fight against the nuclear waste dump in his Presidential campaign, and I am proud that now he will deliver on his promise.

President Obama has made a critical first step towards fulfilling his promise to end the Yucca Mountain project, and I could not be happier for the people of Nevada. Make no mistake: this represents a significant and lasting victory in our battle to protect Nevada from becoming the country's toxic wasteland. I have worked for over two decades with help from our state's leaders and thousands of Nevadans to stop Yucca Mountain. President Obama recognizes that the proposed dump threatens the health and safety of Nevadans and millions of Americans, and his commitment to stop this terrible project could not be more clear.

Conca has been assigned by the state of New Mexico to monitor the environment around a different federal nuclear dump, one used for defense-related plutonium, and where others see problems, he sees opportunity.

Most Americans are unaware that one of the greatest threats to their freedom may be a United Nations program known as Agenda 21. The United Nations Department of Economic and Social Affairs, Division for Sustainable Development created Agenda 21 as a sustainability agenda which is arguably an amalgamation of socialism and extreme environmentalism brushed with anti-American, anti-capitalist overtones.


A detailed history on sustainable development, definitions, and critical actions can be found here. Section III of the Agenda 21 Plan addresses local community sustainable development. The Preamble and Chapter 28 discuss how Agenda 21 should be implemented at a local level. The United Nations purposely recommends avoiding the term Agenda 21 and suggests a cleverly named alternative: "smart growth." Participating in a UN-advocated planning process would very likely bring out many of the conspiracy-fixated groups and individuals in our society such as the National Rifle Association, citizen militias and some members of Congress. This segment of our society who fear 'one-world government' and a UN invasion of the United States through which our individual freedom would be stripped away would actively work to defeat any elected official who joined 'the conspiracy' by undertaking LA21. So, we call our process something else, such as comprehensive planning, growth management, or smart growth [emphasis added].

Undoubtedly, residents of any town, county, or city in the United States that treasure their freedom, liberty, and property rights couldn't care less whether it's called Agenda 21 or smart growth. A recent example of this can be found in Carroll County, Maryland, where a smart growth plan called Pathways was drafted by the County Planning Department. The plan, if enacted, proposed a breathtaking reshuffling of land rights:

•Rezoning of thousands of acres of beautiful, low-density agricultural farmland and protected residential conservation land into office parks

•Down-zoning of agriculture land to prevent future subdivision by farmers

•Up-zoning of low-density residential land around small towns into higher density zoning to permit construction of hundreds or possibly thousands of inclusive housing units, including apartments and condominiums

•Inclusive housing with placement of multi-family construction on in-fill lots within existing residential single family communities

•Endorsement of government-sponsored housing initiatives (subsidies) to ensure healthier, balanced neighborhoods

Carroll County, Maryland is one of 1,168 cities, towns, and counties worldwide that are members of the International Council for Local Environmental Initiatives (ICLEI) - Local Governments for Sustainability, which is an international association of local governments as well as national and regional local government organizations that have made a commitment to sustainable development. The ICLEI mission statement closely resembles that of Agenda 21. In fact, the ICLEI has Special Consultative Status with the UN Economic and Social Council and coordinates local government representation in the UN processes related to Agenda 21.

Community leaders working together in Carroll County recently defended their county against overreaching smart growth initiatives. Richard Rothschild, a candidate for Commissioner, emphatically remarks, "Smart growth is not science; it is political dogma combined with an insidious dose of social engineering. Smart growth is a wedding wherein zoning code is married with government-sponsored housing initiatives to accomplish government's goal of social re-engineering. It urbanizes rural towns with high-density development, and gerrymanders population centers through the use of housing initiatives that enable people with weak patterns of personal financial responsibility to acquire homes in higher-income areas. This has the effect of shifting the voting patterns of rural municipalities from Right to Left."

Smart growth plans usurp property rights and constitutional rights. Local officials, at the behest of State Government, revise zoning laws to fit into a "smart code" zoning template. A massive reshuffling of property rights ensues. Farmers may lose subdivision rights; conservation land adjacent to population centers may be rezoned into commercial employment centers; and low-density land in small towns is re-designated as growth area and rezoned to accommodate diverse housing including high-density apartments and condominiums.

Finally, a healthy dose of federal- or state-sponsored housing initiatives is embraced to ensure communities are properly balanced. The net effect of these plans is to create highly urbanized population centers throughout otherwise-rural counties, while simultaneously limiting the availability of land for suburban and estate subdivisions, as these are considered an unsustainable waste of land by Agenda 21 disciples.

Clearly, smart growth plans will impact Americans' future choices in where and how they live. Furthermore, the Environmental Protection Agency (EPA) and other federal and state agencies may attempt to deny grant funds to states and cities that do not adopt smart growth plans.

Most Americans will remain unaware of the implications of smart growth and Agenda 21 until after it is promulgated in their own backyards. Ironically, these plans are more insidious than the Eminent Domain ruling by the Supreme Court in the case of Kelo v City of New London. Under Eminent Domain rulings, property owners usually receive compensation for their losses.

Conversely, smart growth municipal plans, required by statute, enable municipalities to change zoning laws and engage in other regulatory actions that devalue property, restrict off-conveyances, and otherwise erode property values without payment of any compensation to the property owner.

Smart growth has another interesting unintended consequence: it can disrupt conventional alliances and lead to strange political bedfellows. Rural urbanization plans may raise the ire of environmental groups while simultaneously stirring the wrath of both conservative and liberal residents that want to maintain the rural fabric of their communities. Conversely, developers, sensing opportunity, may side with government smart growth bureaucrats in support of these plans.

Regardless of political orientation, two indisputable facts remain. Agenda 21 is a direct assault on private property rights and American sovereignty, and it is coming to a neighborhood near you.

Capping and Trading for Profit

algore-pollution-money-200The Washington Times reports that three utilities and two manufactures, Nike Inc. and Apple Inc., resigned from the U.S. Chamber of Commerce because of the chamber's fight against the proposed "cap-and-trade" legislation ("Backers of climate bill quit chamber," Page 1, Tuesday).

I worked for the Federal Energy Regulatory Commission and its predecessor, the Federal Power Commission, for 32 years, and that experience taught me that no corporation or utility acts in the interest of the American environmental or social conscience.  You can be assured that Nike, Apple and the three utilities want a cap-and-trade bill to pass the House and Senate because it will strengthen their position in the marketplace and increase their profits.

Nike has installed energy-monitoring devices in its manufacturing plants in China and Vietnam in an effort to cut energy consumption.  That's a noble effort, but even if Nike fails to cut its energy consumption, it will not be penalized by a U.S. cap-and-trade law because its energy consumption and its manufacturing take place outside U.S. borders.

Apple is in the same boat with its overseas production.  It has undertaken a program to reduce the energy consumption of its finished products, but it will not suffer any impact to its profits due to passage of a cap-and-trade bill.

The three utilities that want to see a cap-and-trade bill passed are PG&E of California, Exelon Corp. of Chicago and PNM Resources Inc. of New Mexico.  PG&E has been heavily invested in hydroelectric generation since it came into being and has significant nuclear power generating resources; both of these will be profit boons under a cap-and-trade bill.  Eighty-three percent of Exelon's electric generation resources are nuclear, which will make it a profit king under a cap-and-trade bill.  PNM Resources is a 10-percent owner in the Palo Alto nuclear-generating station near Phoenix.  All of these corporations have everything to gain and nothing to lose if the cap-and-trade bill becomes law.

     It has been suggested that o'who?, the clown, and 'those who surround him' are not the bumbling fools they appear to be.  Nor are they one of the 'Three Stooges' but rather are shrewd implementation/drivers and fellow-travelers of policies designed to disarm the citizenry & collapse the American economy.  Why?  o'nocchio's grandiose scheme to "fundamentally transform America" is more than simple campaign rhetoric as can be seen by his use of "enabling acts" to circumvent the Constitution of the United States.  As Ollie used to say, "Well, here's another nice mess you've gotten me into."
