     We have been warning that President Obama's 23 "executive actions" limiting gun rights was just the camel's nose under the tent, a seemingly harmless foot in the door that is actually a ruse to divert attention from Obama's true agenda and conceal his well-formulated strategy to DISARM AMERICA

     We were right, and the Department of Justice as much as admits it in another secret, smoking-gun memorandum leaked last week.  The memo concedes that gun control will not work to reduce gun violence, indeed will probably make matters worse, and suggests instead a strategy for disarming America when gun control fails.  
     The secret, nine-page DOJ memo ( ) reveals in some detail how the president intends to use the preordained failure of gun control to pave the way toward wide-scale weapons bans and gun confiscation.

     The President's executive actions and the legislation he is backing - such as Senator Dianne Feinstein's so-called "assault weapons" ban and the New York gun-control template being implemented in the Empire State by Governor Andrew Cuomo - are just the stage-one set up.  These stage-one gun-control efforts, as the DOJ memo makes clear, are fully anticipated to fail, and that failure will provide the catalyst for stage two: Outlawing guns and confiscating them.
The memo lays the predicate for disarming America when it explains:

  • Requiring background checks for more gun purchases could lead to more illicit weapons sales; but
  • Convictions, mental health issues, and restraining orders can develop after the background checks.
  • Banning assault weapons and high capacity ammunition magazines produced in the future but exempting those already owned by the public, as Obama has proposed, would have limited impact because people now own so many of those items; and
  • Even total elimination of so-called "assault weapons" would not have a large impact on gun homicides, since assault weapons account for such a limited proportion of gun crimes (an average of 35 out of 11,000 annual gun homicides); however
  • Gun registration and continuous checks for gun-possession eligibility and recovering guns from those that become ineligible for gun ownership will likely be effective; but
  • The challenge is that most states do not have a firearms registry.
     The implications of this memorandum are so obvious one doesn't even have to read between the lines to comprehend that disarming America is the Obama Administration's ultimate objective.  And, here is how they intend to do it.
     The key to the strategy is to create a national gun registry coupled with a sweeping set of new rules and regulations, taxes and fees, requirements and limitations surrounding gun ownership, all so onerous that virtually every gun owner inevitably will find himself or herself "out of compliance" and subject to having their guns confiscated.
     This devious strategy already has been set in motion, and it was presaged in the letters sent out to veterans by the Department of Veterans Affairs in recent weeks.  These letters are a follow-up to the president's expressed desire to force everyone through psychiatric screening as a pre-condition of being allowed to own a gun, using veterans as a trial run.  That letter says, in part:
"A determination of incompetency will prohibit you from purchasing, possessing, receiving, or transporting a firearm or ammunition. If you knowingly violate any of these prohibitions, you may be fined, imprisoned, or both pursuant to the Brady Handgun Violence Prevention Act, Pub.L.No. 103-159, as implemented at 18, United States Code 924(a)(2)."
     So you see, the strategy is first to turn everyone into a "lawbreaker," which then can be used as the pretext for confiscating their guns.  Presto, Second Amendment erased.
     The Father of the Bill of Rights, George Mason, predicted in 1788 that the government would someday attempt to disarm the citizenry unless there was a strong constitutional amendment barring government from doing ANYTHING to abridge the right of people to keep and bear arms, as the Second Amendment was intended to do. Mason said:
"When the resolution of enslaving America was formed in Great Britain, the British Parliament was advised by an artful man, who was governor of Pennsylvania, to disarm the people; that it was the best and most effectual way to enslave them; but that they should not do it openly, but weaken them, and let them sink gradually."
     Letting America "sink gradually" into a state of total disarmament is precisely what this president and many in this Congress on both sides of the aisle intend to do with their so-called "gun safety" laws.  It's another Washington scam, and this time the scam is to circumvent the Second Amendment by first turning you into a "lawbreaker," which will make you "ineligible" to own and weapon, and then, under the color of law, the government will disarm you.
     The DOJ memo, written under the name of Greg Ridgeway, acting director of the National Institute of Justice and one of DOJ's leading crime researchers, makes it apparent that the Obama Administration knows full well its executive actions and legislative proposals are destined.  Of course they will fail; THEY ARE DESIGNED TO FAIL, and to fail in a way designed to lead directly and inevitably to wide-scale gun bans and gun confiscation!
     There you have it.  Obama is playing a devious strategy to disarm America.  First he intends to label as many people as possible "mentally unfit" to own a gun.  Second, he intends to turn everyone else into a lawbreaker by putting so many onerous gun laws in place that virtually everyone will become "non-compliant."  Then using "non-compliance" with the law as an excuse, he will confiscate guns on the pretext that "lawbreakers are not permitted to own a gun."  It's the devil's own logic.

     A 19-year-old sailor stationed in Annapolis, Md., in 1968 was arrested for getting into a fight with an alleged member of a street gang.
     Now, more than four decades later, the 64-year-old U.S. Navy veteran has been stripped of his right to own a gun.
     Jefferson Wayne Schrader of Cleveland, Ga., has been fighting a losing battle in the courts since 2008 to get his name off the fed’s firearm ban list.  In fact, just last month, a federal appeals court in Washington, D.C., upheld a lower-court ruling barring him from owning a firearm.
     “It’s a depressing thing.  A depressing thing,” he told TheBlaze in a phone interview, “to have the government treat you like that.  It’s not, well, it’s not a good thing.”
     The ban list is meant to prevent people of questionable standing, including illegal aliens, drug addicts, people dishonorably discharged from the U.S. military, and fugitives, from buying or selling guns.
     And although Schrader — a certified expert with a handgun — served in Vietnam from Jan. 1, 1968, until being honorably discharged in September 1970, the U.S. government believes he is unfit to own a gun because of his teenage misdemeanor.
     “Due to a conviction some forty years ago for common-law misdemeanor assault and battery for which he served no jail time, plaintiff Jefferson Wayne Schrader, now a sixty-four-year-old veteran, is, by virtue of 18 U.S.C. § 922(g)(1), barred for life from ever possessing a firearm,” U.S. Circuit Judge David Tatel wrote in the court’s January opinion.
     “In rejecting plaintiffs’ constitutional claim, the district court relied on the Supreme Court’s observation in District of Columbia v. Heller that ‘the right  secured by the Second Amendment is not unlimited,’ as  well as the Court’s inclusion of ‘longstanding prohibitions on the possession of firearms by felons’ within a list of  ‘presumptively lawful regulatory measures,’” Judge Tatel added.
     In its ruling against Schrader, the fed appeals court cited the Gun Control Act of 1968 signed into law by President Lyndon Johnson, which makes it more difficult for questionable characters to engage in interstate commerce involving firearms.
     But we’ll come back to that later.
     The other gun law that led to Schrader’s odd set of circumstances is the Brady Handgun Violence Prevention Act of 1993.  This bill laid the groundwork for the FBI’s 1998 National Instant Criminal Background Check System (NICS).
     So when Schrader tried to buy a handgun in 2008, the NICS flagged his 45-year-old misdemeanor – which only now qualifies in Maryland for a sentence of two or more years in prison – and he was disqualified from making the purchasing.

     But here’s the weird thing: Schrader has been selling and trading guns for a long time.
     “I’ve bought and sold probably, oh, a dozen maybe 15 guns over a 42 year time period” he said.  “I never had a problem with it.  I was just surprised it happened at all.  The ATF [Bureau of Alcohol, Tobacco, Firearms and Explosives] agent said I wasn’t allowed to have any guns.”
     “But he said I could keep my black powder rifle.  Thank you very much,” he added sarcastically.
     As mentioned in the above, it all started in 2008 when an NICS check flagged Schrader’s name for his 1968 misdemeanor.
     The FBI blocked Schrader’s wife, Harriet, from buying him a shotgun for his birthday and then blocked him on two different occasions from buying a handgun.
     But let’s back up for a second and revisit his 1968 misdemeanor.
     As Schrader told TheBlaze, one evening in Annapolis he and his Navy buddies were attacked by a street gang while walking back to base.  A few weeks later, Schrader saw one of his attackers hanging out on a street corner.
     “I told the guy driving to stop and let me out,” Schrader said, “and I walked over to him and was going to tell him, ‘You need to come with me, we’re going to talk you over to the police station.’  And he said, ‘Oh, you want some more?’ and stood up.”
     As official court documents show, “a dispute broke out between the two, in the course of which Schrader punched his assailant.”
     Unfortunately for Schrader, he didn’t see the two police officers “sitting at the red light.”
     The sailor was arrested and convicted of common-law assault and battery.  He was told he could pay a $109 fine, which included court costs, or spend thirty days in the hole.
     He chose the former.

     After paying the fine, Schrader went on to serve a 21-month tour of duty in Vietnam and was honorably discharged upon his return.
     From that time forward, according to the complaint, he had no scrapes with the law (except for one traffic violation).
     After going more than five decades without any serious trouble with the law, the 2008 background check came as a shock to Schrader.
     “I don’t know why they’re coming after me,” Schrader said.  “All I did was punch someone in the nose.”
     So what’s the court’s reasoning?
     The Gun Control Act (remember we said we’d come back to this?) specifically includes a ban on anyone convicted of a misdemeanor punishable under state law by up to two years in prison.
     Okay, but Schrader never had to serve a two-year prison sentence.
     This is where it gets interesting.  At the time of his arrest, the state of Maryland did not set any maximum sentence for common-law assault and battery convictions.
     However, the DOJ reasons that because Maryland would have given him two or more years if it had the laws it has today, well, that’s good enough to keep Schrader on the banned list.
     Two years after having his name flagged for the Annapolis fight, Schrader sued to challenge the ban and he has been fighting it ever since.  Unfortunately, things haven’t gone his way.
     “All I can do now is wait and see what my attorney can do,” Schrader told TheBlaze.
     His lawyer, Alan Gura, a prominent civil rights attorney, says there are still a few options left.

     “Today is our deadline for filing a petition for rehearing and rehearing en banc in the Schrader case,” Gura told TheBlaze in an email on Monday.
     “Some misdemeanors are very serious and Congress can address those specifically,” he added later in a phone interview, “but to broadly disarm anyone who has ever been involved in even a minor scuffle, 45 years later, seems to be excessive.”
     “We hope that the court rehears the case.  We think it’s worthy of that.  It raises the types of questions that courts often find they need to rehear.  If the court does not decide to reconsider the case then, of course, we will consider the next step, which will be a petition to the Supreme Court.”
     A spokeswoman with the U.S. Department of Justice did not immediately respond to TheBlaze’s request for comment.

     This widely distributed Nazi pamphlet first appeared in 1929.  I am working from a 1932 copy, and have not compared it with the first version, but it does not look as if significant changes were made as it was reissued.  The title, loosely translated, is "Those Damned Nazis."  Literally, it translates as something like "those cursed swastika lads," but that does not really work in English.  At least several hundred thousand copies were printed.  It is a good summary of the basic lines of Nazi propaganda just before Hitler's takeover in 1933.  The booklet included five cartoons by Mjölnir, Goebbels' cartoonist, three of which I include here.  Mjölnir also produced some of the most familiar Nazi posters.

     "Horrible … fascinating …" reads this newspaper ad for the newly released Goebbels Diaries.  A reviewer for the New York Times hailed the book as a vivid portrait of "Dr. Joseph Goebbels, the little, limping, ratfaced high priest of nazism … one of the most completely evil men of the twentieth century."  The book was serialized in newspapers and magazines, was picked for the Book-of-the-Month Club, and became an instant bestseller.

     Consider that the o'liar-in-chief is on his never-ending-campaign quest to convince the electorate and sway Congress, using his Hitleresque "Big Lie" technique, that 'sequestration' and spending cuts would "destroy our economy."  He would have you believe that his lack of leadership, his failed policies, and his appeasement of our enemies has had no bearing on our fiscal woes.  
     He continues to lambast what every right thinking individual knows - that you can't spend what you don't have.  His latest blatant lie mantra is to disparage fiscal conservatives who rightly, but with little heed from the o'bamanation audience, have tried to expose the fact that o'tax'n spend's idea of 'tax cuts' is simply a reduction in future growth spending by the federal government.  He deliberately conceals in his rhetoric that the only real cuts he intends to commit is in the national defense.
    As a friend said today, o'who? had an opportunity to be a great president given the circumstances of his birthright and the economic situation extant at his election; instead, he has chosen "The Dark Side". -- rfh

Obama Is Wrong About the Need to Raise Taxes

     With a March 1 deadline looming for the imposition of the automatic spending cuts known as the sequester,  President Obama and his allies in the press are stepping up their campaign for additional tax increases on the rich.
     Obama said over the weekend that his plan "asks more of the wealthiest Americans," and he said it looks like Republicans are "prepared to inflict more pain on the middle class because they refuse to ask anything more of those at the very top."  The president's allies at The New York Times issued an editorial under the headline "Why Taxes Have to Go Up," insisting, "To reduce the deficit in a weak economy, new taxes on high-income Americans are a matter of necessity and fairness."
     Here are five reasons Obama and the Times are wrong about this.
     Taxes are already high.   Californians this year face a combined federal-state income tax rate of 51.9 percent on earnings over $1 million, and upper-income New York City residents are taxed at a 51.7 percent combined city, state, and federal rate, a phenomenon that even the Times itself recognized earlier this month as front-page news.  Government, in other words, is already taking more than half of every marginal dollar earned.
     The Times editorial claims that "Even with recent increases, the new top rate of 39.6 percent is historically low."  It justifies that claim with a hyperlink to a table that says "Note: This table contains a number of simplifications and ignores a number of factors…Perhaps most importantly, it ignores the large increase in percentage of returns that were subject to this top rate."  That disclaimer isn't mentioned in the Times editorial.  Nor is the fact that, according to the table to which the Times links, in 1988 and 1989, the top rate was 28 percent, or that in 1990, 1991, and 1992 it was 31 percent.  In addition, speaking of history, the Medicare payroll tax didn't apply in the pre-Medicare days.  America didn't have an income tax at all, with rare wartime exceptions, until the Sixteenth Amendment was ratified in 1913.      Raising rates higher than current levels would be impractical.  The higher rates would so encourage tax avoidance and discourage extra work that the returns in increased government revenue would start to diminish.  Even John Maynard Keynes wrote that "25 percent taxation is about the limit of what is easily borne" and that "Aggressive taxation may defeat its own ends by diminishing the income to be taxed."
     It's also not moral.  How can Obama justify taking for the government more than half of a dollar someone else has earned?  That leads us to the next objection:
     Taxation without representation isn't fair.  It's one thing for a group of individuals to associate themselves voluntarily and tax themselves to fund common services.  But the more steeply progressive the tax code gets, and the greater share of taxation that is borne by a small, high-income minority, the more our tax system starts to look like what got Samuel Adams and company so riled up against George III and Parliament back in the 1760s and 1770s.  Just as the British voted to fund their government by increasing taxes on the colonists rather than themselves, so the Americans who earn less than President Obama's definition of rich voted to fund their government services by increasing income taxes on the rich rather than on themselves.  One may object that the rich have plenty of representation by way of lobbyists, campaign contributions, and independent expenditures, and that a lot of the senators and congressmen are rich themselves.  But we still have a one-person, one-vote system.
     The exit polls from the 2012 election showed that Mitt Romney won voters with family income from $50,000 to $99,999, by 52 percent to 46 percent.  Romney won voters with family income of $100,000 to $199,999, by 54 percent to 44 percent, and voters with family income of $200,000 or more, 54 percent to 44 percent.  The only income groups that President Obama won, according to the poll, were those with family income less than $30,000, which Mr. Obama won 62 percent to 35 percent, and those with family income $30,000 to $49,999, which Obama won 56 percent to 42 percent.  [emphasis added - rfh]  You don't have to be a Marxist political economist to observe that Obama is trying to impose a big tax increase on a lot of people who didn't vote for him.  At least those rich people got to vote, which is more than can be said for the colonists.  But there's something ugly about the whole thing.

     Raising taxes hurts growth. Slower growth makes the deficit bigger, not smaller.  The best thing for tax revenues, for the deficit problem, and for America overall would be robust economic growth.  But the government reported negative real economic growth for the fourth quarter of 2012, and there are some signs that the payroll and income tax increases that took effect in January 2013 are already inflicting more damage.   Why slow an already sluggish economy by increasing taxes even more?  Don't just take it from me; even Paul Krugman, the Nobel Laureate New York Times columnist, once wrote, "High marginal tax rates can hurt economic growth."
     The problem isn't taxes, it's spending (and the dollar, which hardly anyone talks about).  The Times editorial disputes this, contending, "Contrary to Mr. Boehner's 'spending problem' claim, much of the deficit in the next 10 years can be chalked up to chronic revenue shortfalls from the Bush-era tax cuts… a deficit caused partly by inadequate revenue must be corrected in part by new taxes."  Yet that's nonsense.   Washington is awash in revenue.  President Obama's own Office of Management and Budget reports that tax revenue in 2011 was $2.3 trillion.  That's about $275 billion more than the $2.025 trillion that arrived in 2000, before President George W. Bush was even inaugurated.
     No, the problem isn't on the revenue side.  It is on the spending side; the federal government spent $3.6 trillion in 2011, about $1.8 trillion more than the roughly $1.8 trillion it spent in 2000.  In other words, federal spending doubled in about a decade.  Tax revenue grew more than 10 percent, but that wasn't enough to keep pace with the spending.
     If there's a revenue shortfall or if the comparisons seem strange, it may have something to do with the fact that today's dollars are worth less than they were worth in 2000.  Now there would be a fine topic for some congressional or presidential leadership, but the politicians, alas, seem to prefer the current set-up, under which they can deflect responsibility toward the "independent" Federal Reserve.
     The tax-raising isn't going to stop with the rich.  Tax increases on the rich are just the first step.   When President Obama tells you he just wants to raise taxes on the rich, he's fibbing.  He's already raised taxes on cigarettes and tanning salons, and he raised the payroll tax on everyone at the beginning of this year.   At least The New York Times, unlike Obama, is forthright about its goals; the Times editorial called additional tax increases on the rich "a necessary precondition to what in time will have to be tax increases on the middle class," asserting, "more taxes will be needed from further down the income scale."  Likewise, the Center on Budget and Policy Priorities, in a paper linked to by the Times editorial, says of the Bush tax cuts: "Letting those tax cuts lapse on schedule — for everybody, not just for people with incomes over $200,000 for an individual or $250,000 for a couple — would put deficits and debt on a sustainable path."
     Republicans would be in a stronger position to fight now if some of their leaders in Congress had not, in early January, provided President Obama with votes he needed to raise tax rates in 2013 from the levels they had been at in 2012.  After all, if voters think both Republicans and Democrats are going to raise taxes, they might as well decide based on other issues.  If the Republicans cave again this time around, they risk losing credibility on the tax issue for another election cycle.
