     Medicare released a new regulation that will pay physicians for discussing end-of-life treatment options with their patients. This provision was originally included in "ObamaCare," but Democrats removed it after a hailstorm of criticism arose regarding so-called "death panels" that would allegedly pressure elderly patients to forgo life-saving treatment.
     The language comes from Rep. Earl Blumenauer (D-OR), the author of the original end-of-life proposal, whose state is 1 of only 2 that allow physician-assisted suicide. The New York Times reported an email from his office saying, "Thus far, it seems that no press or blogs have discovered it, but we will be keeping a close watch and may be calling on you if we need a rapid, targeted response. The longer this goes unnoticed, the better our chances of keeping it."
     The "voluntary advance care planning" language was hidden on page 238 of a nearly 700-page document, the implementation of which begins in four days on January 1, 2011. The regulation will cover "(1) [a]n individual's ability to prepare an advance directive in the case where an injury or illness causes the individual to be unable to make health care decisions. (2) Whether or not the physician is willing to follow the individual's wishes as expressed in an advance directive."
     Liberty Counsel is challenging the ObamaCare law, which will now be heard by the Fourth Circuit Court of Appeals. Judge Norman Moon found that Liberty University and 2 individual plaintiffs had standing to assert their constitutional claims against the individual and employer mandates in the healthcare law and that their claims were ripe for consideration.

Passage of the so-called "health care reform" bill in the House of Representatives this past Sunday, March 21 (I won't even address the inferred unconstitutionality of Congress doing business on the Lord's Day. See Article. I. Section. 7. Paragraph. 2.) drove yet another stake into the heart of America. For all intents and purposes, it is the health of the United States that is in dire need of healing. In fact, the US has been on extended life-support for decades. With its condition being rendered critical, and absent major surgery, its days are numbered. The passage of this bill only serves to further weaken an already frail Constitution. In fact, this one may prove to be the fatal blow. Lady Liberty may never recover.

The decision by Congress to socialize medicine in the US ranks among the most draconian, most egregious, most horrific actions ever taken by the central government in Washington, D.C. This bill rocks the principles of liberty and constitutional government to the core. It changes fundamental foundations; it repudiates historical principle. Oh! The same flag may fly on our flagpoles, the same monuments may grace our landscape, and the same National Anthem may be sung during our public ceremonies, but it is not the same America. The Congress of the United States has now officially turned America into a socialist state.

On March 23, 2010, President Barack Obama signed the health care bill into law, and as such, this date--along with March 21--joins a list of dates that have each inflicted unconstitutional, socialistic, and sometimes even tyrannical action against the States United and have, therefore, contributed to the destruction of a free America.

April 9, 1865

This is the date when General Robert E. Lee surrendered the Army of Northern Virginia to U.S. Grant at Appomattox Court House, Virginia. Regardless of where one comes down on the subject of the Civil War, one fact is undeniable: Abraham Lincoln forever destroyed the Jeffersonian model of federalism in America. Ever since, virtually every battle that free men have fought for the principles of limited government, State sovereignty, etc., have all stemmed directly from Lincoln's usurpation of power, which resulted in the subjugation and forced union of what used to be "Free and Independent States" (the Declaration of Independence). In fact, the philosophical battles being waged today regarding the recent health care debacle (and every other encroachment upon liberty and State power by the central government) have their roots in Lincoln's tyranny.

July 9, 1868

This is the date when the 14th Amendment was ratified. This amendment codified into law what Lincoln had forced at bayonet point. Until then, people were only deemed citizens of their respective states. The Constitution nowhere referred to people as “US citizens.” It only recognized “the Citizens of each State.” Notice also that citizenship was only recognized among the “several States,” not among people living in non-State territories. Until the 14th Amendment, people were “Citizens of each State.” (Article. IV. Section. 2. Paragraph. 1.) The 14th Amendment created a whole new class of persons: “citizens of the United States.” This false notion of “one nation” overturned the Jeffersonian principle that our nation was a confederated republic, a voluntary union of states.

February 3, 1913

This is the date when the 16th Amendment was ratified, and the direct income tax and IRS were instituted. This was a flagrant repudiation of freedom principles! What began as a temporary measure to support the War of Northern Aggression became a permanent income revenue stream for an unconstitutional--and ever-growing--central government.

April 8, 1913

This is the date when the 17th Amendment was ratified. This amendment overturned the power of the State legislatures to elect their own senators and replaced it with a direct, popular vote. This was another serious blow against State sovereignty. The framers of the Constitution desired that the influence and power in Washington, D.C., be kept as close to the people and states as possible. For example, the number of representatives in the House of Representatives was to be decided by a limited number of voters. In the original Constitution, the ratio of "people of the several States" deciding their House member could not exceed "one for every thirty thousand." (Article. I. Section. 2. Paragraph. 3.) And when it came to the US Senate, the framers also recognized the authority of each State legislature to select its own senators, thereby keeping power and influence from aggregating in Washington, D.C. The 17th Amendment seriously damaged the influence and power of the states by forcing them to elect their US senators by popular vote. The bigger the State, the less influence the State legislature has in determining its US senator. Senators who answered to State legislators, each answering to a limited number of voters, are much more accountable to the "citizens of the several States" than those who are elected by a large number (many times numbering into the millions) of people. For all intents and purposes (at least in the larger states), US Senators are more like "mini-Presidents" than they are representatives of sovereign states.

December 23, 1913

This is the date when the Federal Reserve Act was passed. This Act placed oversight of America's financial matters into the hands of a cabal of private international bankers, who have completely destroyed the constitutional principles of sound money and (for the most part) free enterprise. No longer would the marketplace (private consumption, thrift, growth, etc.) be the determinant of the US economy (which is what freedom is all about), but now a private, unaccountable international banking cartel would have total power and authority to micromanage (for their own private, parochial purposes) America's financial sector. Virtually every recession, depression, and downturn (including the one we are now experiencing) has been the direct result of the Fed's manipulation (again, for its own purposes and with Washington's cooperation) of the market.

June 26, 1945

This is the date when the United Nations Charter was signed and America joined the push for global government. Ever since, US forces have spilled untold amounts of blood and sacrificed thousands of lives promoting the UN's agenda. Since the end of World War II, in virtually every war in which US military forces have been engaged, it has been at the behest of the UN. And it is also no accident that America has not fought a constitutionally declared war since we entered the UN--and neither have we won one.

Furthermore, it is America's involvement in the United Nations that has spearheaded this draconian push for a New World Order that George H. W. Bush, Henry Kissinger, Tony Blair, Walter Cronkite, et al., have talked so much about. The United Nations is an evil institution that has completely co-opted our US State Department and much of our Defense Department. It is an anti-American institution that works aggressively and constantly against the interests and principles of the United States. But it is an institution that is ensconced in the American political infrastructure. Like a cancer, the UN eats away at our liberties and values, and both major political parties in Washington, D.C., are culpable in allowing it to exert so much influence upon our country.

June 25, 1962, and June 17, 1963

These are the dates when the US Supreme Court removed prayer ('62) and Bible reading ('63) from public schools. At this point, these two Supreme Court decisions were the most serious affront to the First Amendment in US history. Think of it: from before a union of states was established in 1787, children had been free to pray and read the Scriptures in school. We're talking about a period of more than 300 years! Of course, the various State legislatures--and myriad city and county governmental meetings--still open their sessions in prayer, as do the US House and Senate, and even the US Supreme Court. But this same liberty is denied the children of America. There is no question that America has not recovered from these two horrific Supreme Court decisions. In effect, the federal government has expelled God not only from our public schools, but also from our public life! And America has not been the same since.

October 22, 1968

This is the date when President Lyndon Baines Johnson signed the Gun Control Act of 1968. Before this Act, the 2nd Amendment was alive and well in the United States. The Gun Control Act of 1968 turned a right into a privilege and forever forced the American people to bow to the altar of government when seeking to arm themselves. Interestingly enough, this Gun Control Act mirrored Nazi Germany's Gun Control Act of 1938. In fact, the Gun Control Act of 1968 is almost a verbatim copy of Hitler's Gun Control Act of 1938.

Our Founding Fathers could never have imagined that governments within the "several States" would ever be allowed to deny the people's right to keep and bear arms. In fact, it was the attempted confiscation of the firearms stored at Concord, Massachusetts, that triggered the War of Independence in 1775. That the people of Massachusetts would be denied their right to keep and bear arms, as they are today, could not have been foreseen--and would never have been tolerated--by America's founders.

Yet, most of the hundreds of draconian gun control laws that have been inflicted upon the American people have all come about as a result of the Gun Control Act of 1968.

January 22, 1973

This is the date when the US Supreme Court issued the Roe v. Wade and Doe v. Bolton decisions, which, in effect, legalized abortion-on-demand. These two decisions expunged the Jeffersonian principle that all men are endowed by their Creator with the unalienable right to life (Declaration). Since then, more than 50 million unborn babies have been legally murdered in their mothers' wombs. Abortion is, without a doubt, America's national holocaust. It has opened the door to a host of Big Government programs and policies that have resulted in the wanton destruction of human life both in the United States and overseas. It has created an entire industry whose express purpose for existing is the destruction of human life. It has desensitized the conscience and soul of America. Furthermore, it has forced men of decency and good will to finance--with their tax dollars--the unconscionable act of killing unborn children.

And once again, another Jeffersonian principle was eviscerated. He said, "To compel a man to furnish contributions of money for the propagation of ideas which he disbelieves and abhors is sinful and tyrannical." The Roe and Doe decisions violate this principle in the most egregious manner possible.

October 26, 2001

This is the date when President George W. Bush signed the USA Patriot Act, and the federal government's war against individual liberty began in earnest. Most of the unconstitutional eavesdropping, snooping, wiretapping, phone call intercepting, email reading, prying, financial records tracking, travel watching, ad infinitum, ad nauseam, by federal police agencies began with the implementation of the Patriot Act. The Department of Homeland Security and the "war on terrorism," which have resulted in the deaths of tens of thousands of innocent people worldwide, and the usurpation of federal power at home, have all come about as an outgrowth of the Patriot Act. The USA Patriot Act has forever shifted the focus of American law and jurisprudence against constitutional government and individual liberty, toward a police-state mentality. The Patriot Act is even turning our local and State law enforcement agencies into military-style "Jackboots," where police officers see themselves not necessarily as guardians of the citizenry, but, as often as not, as adversaries, where citizens are deemed to be the "enemy."

October 17, 2006, and October 9, 2009

These are the dates when President G.W. Bush signed and re-signed the Military Commissions Act. This Act is the outgrowth of the Patriot Act but has, in effect, terminated the fundamental protections of individual liberty, which are found in the US Constitution and Bill of Rights. For all intents and purposes, the Patriot Act and Military Commissions Act eviscerated the 4th and 5th Amendments, and do serious injury to several others. The Military Commissions Act also expunges the constitutional right of Habeas Corpus.

March 21 and 23, 2010

These are the dates when Congress passed and President Obama signed into law the "Patient Protection and Affordable Care Act," the so-called "health care reform" bill that we spoke about at the beginning of this column. While Social Security and various Welfare programs have toyed with socialism in the United States, this bill is the largest and most expansive endorsement of socialism in American history. This bill socializes some 18% of the US economy by socializing the health care industry in America. The fallout and ramifications of this bill are going to be horrific.

When future historians review the demise of our once-great republic, they will observe that the above dates, including March 21 and March 23, 2010, were the dates that destroyed America. The American people have been far too tolerant for far too long.

People concerned about the future of freedom and prosperity in America should line up quickly and demand that their respective State legislatures and governors resist this new health care bill, even to the point of refusing to implement it in their states. More than 30 states are threatening to take the health care bill to court. But states must do more than that. They must follow the lead of the State of Virginia and pass legislation refusing to comply with it. Yes, I'm saying it: it is time for another State rebellion! If states do not stand up and draw their lines in the sand now, it will be forever too late.

Yesterday, Majority Leader Harry Reid [standing nakedly alone before a hastely gathered group of news cameras] announced that he's including a compromise version of the public option [Read as 'screw' the will of the people.]  in the Senate health care bill —but a few conservative Democrats [honest legislators, Mr. Smiths ...so-to-speak] are still threatening to join a Republican filibuster and block reform [read as might expose the sham].¹

We're ready to fight back [Chicago Style thuggery] and hold them accountable. [bully, intimidate, threaten] Over the weekend, 93% of MoveOn members voted [ninety three percent who?] to withhold support [take time to consider the ramifications of scamcare & their constituents' concerns]  from any Democrat who helps block an up-or-down vote [the "nuclear" option, ignore the will of the people] on a health care bill with a public option.

So it's time to swing into action and turn up the heat [make toe the line or line'em up to be shot down] on these Democratic holdouts [honest politicians] —and to get started,

Our member vote [threats] can provide a clear incentive [coercion] to senators who are deciding where they stand on Senator Reid's bill. [ here comes o'who?'s 'domestic security force 'street mob' --> ] So MoveOn members are hitting the streets, and the phones, to get the word out.  We've planned in-person events [intimidate, shout down, use Jesse Jackson 'rainbow coalition' blackmail tactics] at the state offices of conservative Democrats starting today, we're developing a new round of ads [propaganda, who pays for them?], and we'll be flooding their offices with phone calls all week [garner publicity by any means, block attempts by honest constituents to get through].

At the same time, we need to be clear: the "opt-out" version of the public option has real problems [if it was legitimate, it would be "opt-in"]. The most conservative states [is conservative bad?, liberal states with high taxes already likely would opt-out as well] in the country would likely opt out, potentially leaving millions of uninsured folks [why don't they buy insurance, if they can afford it]  without access to the affordable health care a public option would provide [make honest wage earners & real tax payers foot the bill for those who don't pay taxes or are illegal].

So while this compromise version [a Democrat euphamism for bait-and-switch tactics] of the public option could help get a bill through the Senate, we need to push hard through the rest of the legislative process to make sure the final bill has a robust public option [like the street con "3 card Monte", every one loses] that doesn't leave anyone out.  Our progressive champions [o'bama loons, progressive liberals, slobbering socialists, the Marxists, or Communists] in the House [and in the WH & among o'czars and o'czarinas] are fighting hard for that and we'll support their efforts.

Thanks to the tireless efforts of MoveOn members [o'puppet masters] and the broader progressive [socialist, communist, marxist, free loader] movement, the public option now has a ton of momentum [like screaming fire in a crowded theater].   And we're really close [panic time] to having the votes we need in the Senate.  But we need to make sure a few conservative [honest] Democrats don't doom health care reform.

2010 - A 'Party of No' Could Get 'Yes' Votes in November

A winning message for RepublicansIn a Super Bowl pre-game interview, Barack Obama announced that he wants to have a televised meeting with both Republicans and Democrats to discuss ideas about crafting health care legislation. Imagine that -- an open debate with both parties equally represented, hashing out plans and crafting a bill using the best ideas brought to the table. In 2008, Candidate Obama told us that was how health care reform would come to pass in his new bipartisan and transparent Washington. The reality has been far different, though entirely predictable to those who recognized him for what he is: a socialist.

Legislation was crafted not to reform health care, but to put it solely under government control. Deals were made behind closed doors, and yet, even with bulletproof majorities in both chambers, the Democrat Congress has not passed a health care bill.

Now Obama is pretending to play the role of peacemaker, but he views bipartisanship as Republicans submitting to his will. Indeed, he won't agree to scrap the existing legislation and start from scratch, even though the public has made its distaste for the bills quite clear.

House Minority Leader John Boehner has made dropping the current legislation a prerequisite for Republicans to come to the table. It is, after all, a waste of time to debate a bill that's essentially dead. Republicans want to cut costs while Democrats want a health insurance entitlement for all. Both sides want to prevent insurance companies from rejecting ill customers, but Democrats, beholden to trial lawyers, reject the common-sense cost-cutting idea of tort reform, among other free-market measures. Unfortunately, neither side is talking about the constitutional role of government.

Even if the meeting happens, both sides are so deeply entrenched that a compromise is rather unlikely. Besides, Obama may be trying to set a political trap of sorts for Republicans by wooing them to the table, offering them a bad deal, then once again accusing them of being "The Party of No," that mantra so often repeated by his accomplices in the Leftmedia.

Such a label wouldn't be bad, however, considering that the alternative means going along with a plan that would raise taxes, remove competition in the insurance industry, drive down the quality of health care in our country, and add hundreds of billions -- if not trillions -- of dollars to the national debt.

In fact, when combined with advocating fiscal responsibility and constitutional Rule of Law, "Just Say No to Socialism" sounds like a winning formula for Republicans come November. Of course, the GOP would have to awaken from its stupor first.

values - More Independents Choosing ‘Conservative’ in Obama’s First Year, Survey Says

(CNSNews.com) – More self-identified Independents are labeling themselves as “conservative” in 2009 than at any time during the past decade, the Gallup organization found in a recently released study.

In fact, the percentage of American Independents who identified as conservatives – 35 percent – increased at the fastest rate in 10 years between 2008 and 2009, the latter Obama’s first year in office.

“The rather abrupt three-point increase between 2008 and 2009 in the percentage of Americans calling themselves conservative is largely owing to an increase – from 30 percent to 35 percent – in the percentage of political independents adopting the label.

According to a compilation of all Gallup political identification surveys from 2009, 40 percent of Americans identified themselves as conservatives, more than the 36 percent who answered moderate and far more than the 21 percent who answered liberal.

“The increased conservatism that Gallup first identified among Americans last June persisted throughout the year, so that the final year-end political ideology figures confirm Gallup's initial reporting: conservatives (40 percent) outnumbered both moderates (36 percent) and liberals (21 percent) across the nation in 2009,” Gallup reported Thursday.

Democratic leaders explained their brand’s seemingly bad fortunes, saying that the 2009 figures merely reflected the public’s desire to see Obama’s health care agenda pass. Democratic National Committee Chairman Tim Kaine told CBS News that his party would experience a “tailwind” when the president’s signature initiative passes.

“I think the president is about to achieve a victory with the passage of a comprehensive health reform bill that has eluded every Democratic president since Harry Truman and that will create a real tailwind for the president and the party when that happens,” Kaine told CBS’s  “The Early Show.”

“We're starting to see some positive signs,” he said. “We've got more work to do, but I think the passage of historic health care and continued improvement in the economy will surprise some people in November in terms of how Democrats do.”

However, Gallup also found that in a decade that began and ended with liberal presidents, more Americans called themselves conservative or moderate than liberal. From 2000-2009, no more than 22 percent of Americans considered themselves liberal, while both conservative and moderate Americans hovered between 35 and 45 percent, trading places as the largest political identity several times over that period.

In fact, liberals have never made up much more than 20 percent of the country, according to Gallup, over approximately the last 20 years. From 1992 to 2009, liberals never made up more than 22 percent (in 2007 and 2008) of the country.

In a finding that could play out well for Republicans’ mid-term election hopes, conservatism saw its largest single-year gain in support since 1992-1993, the year before Republicans – led by conservative candidates – took control of Congress.

Conservatism saw a three percentage-point gain in 1992-1993 (from 36 to 39 percent). Between 2008 and 2009, conservatism also grew by three points (37 to 40 percent).

The Republican Party continued to be dominated by conservatives, with 71 percent of Republicans calling themselves conservative, as opposed to 35 percent of Independents and only 21 percent of Democrats. Republicans have been becoming increasingly conservative since 2003, growing from 62 percent in 2002 to 71 percent in 2009.

Democrats, likewise, continued becoming more liberal. Thirty-eight percent of Democrats called themselves liberal in 2009, one point less than in 2008 but nine points higher than the 29 percent of liberal Democrats Gallup reported in 2000.

Democrats make up the largest group of self-identified liberals, far outweighing the 18 percent of Independents and only 4 percent of Republicans who choose the label.

Independents continued to flee the “liberal” moniker, according to Gallup, with 78 percent choosing either the conservative (35 percent) or moderate (43 percent) label. 

Is this really a surprise? This guy is a LIAR! 1.Millions Will Lose Their Current Insurance. Period. End of Story: President Obama wants Americans to believe they can keep their insurance if they like, but research from the government, private research firms, and think tanks show this is not the case. Proposed economic incentives, plus a government-run health plan like the one proposed in the House bill, would cause 88.1 million people to see their current employer-sponsored health plan disappear.

2.Your Health Care Coverage Will Probably Change Anyway: Even if you kept your private insurance, eventually most remaining plans—whether employer plans or individual plans—would have to conform to new federal benefit standards. Moreover, the necessary plan “upgrades” will undoubtedly cost you more in premiums.

3.The Umpire Is Also the First Baseman: The main argument for a “public option” is that it would increase competition. However, if the federal government creates a health care plan that it controls and also sets the rules for the private plans, there is little doubt that Washington would put its private sector “competitors” out of business sooner or later.

4.The Fed Picks Your Treatment: President Obama said: “They’re going to have to give up paying for things that don’t make them healthier. … If there’s a blue pill and a red pill, and the blue pill is half the price of the red pill and works just as well, why not pay half for the thing that’s going to make you well.” Does that sound like a government that will stay out of your health care decisions?5.Individual Mandate Means Less Liberty and More Taxes: Although he once opposed the idea, President Obama is now open to the imposition of an individual mandate that would require all Americans to have federally-approved health insurance. This unprecedented federal directive not only takes away your individual freedom but could cost you as well. Lawmakers are considering a penalty or tax for those who don’t buy government-approved health plans.

6.Higher Taxes Than Europe Hurt Small Businesses: A proposed surtax on the wealthy will actually hit hundreds of thousands of small business owners who are dealing with a recession. If it is enacted, America’s top earners and job creators will carry a larger overall tax burden than France, Italy, Germany, Japan, etc., with a total average tax rate greater than 52%. Is that the right recipe for jobs and wage growth?

7.Who Makes Medical Decisions? What is the right medical treatment? And should bureaucrats determine what Americans can or cannot have? While the House and Senate language is vague, amendments offered in House and Senate committees to block government rationing of care were routinely defeated. Cost or a federal health board could be the deciding factors. President Obama himself admitted this when he said, “Maybe you’re better off not having the surgery, but taking the painkiller,” when asked about an elderly woman who needed a pacemaker.

8.Taxpayer-Funded Abortions? Nineteen Democrats recently asked the President to not sign any bill that doesn’t explicitly exclude “abortion from the scope of any government-defined or subsidized health insurance plan” or any bill that allows a federal health board to “recommend abortion services be included under covered benefits or as part of a benefits package.” Currently, these exclusions do not exist.

9.It’s Not Paid For: The CBO says the current House plan would increase the deficit by $239 billion over 10 years. And that number will likely continue to rise over the long term. Similar entitlement bills in the past, including Medicare, have scored much lower than their actual eventual cost.

10.Rushing It, Not Reading It: We’ve been down this road before—with the failed stimulus package. Back then, we also heard that we were in a crisis and that we needed to pass a 1,000-plus-page bill in a few hours—without reading it—or we would have 8% unemployment. Well, we know what happened. Now, one Congressman has even said it’s pointless to read one of the reform bills without two days and two lawyers to make sense of it. Deception is the only reason to rush through a bill nobody truly understands.
